<br />At a Called Meeting of the City Council on Monday, July 23, 2012, there were
<br />present:
<br />Mayor Kenneth I. Wright, Vice Mayor Charles B. Whitehurst, Sr., William E. Moody, Jr.,
<br />Marlene W. Randall, Stephen E. Heretick, Paige D. Cherry, Dr. Curtis E. Edmonds, Sr.,
<br />City Manager Kenneth L. Chandler, City Attorney G. Timothy Oksman.
<br />12 - 291 -The following call for the meeting was read:
<br />"Please attend a Called Meeting of the City Council to be held in the 6t" Floor
<br />Conference Room, 801 Crawford Street, 6:00 p.m., Monday, July 23, 2012 for the
<br />purpose of a Public Work Session.
<br />In addition, you may consider a motion to go into a Closed Meeting.
<br />By order of the Mayor."
<br />12 - 292 -The following items were discussed in Public Work Session:
<br />1. Tourism Zones -Delegate Matthew James
<br />2. Enterprise Zone Designation -Mallory Kahler, Local Enterprise Zone Administrator,
<br />Economic Development
<br />12 - 293 -Motion by Mr. Moody, and seconded by Mr. Whitehurst, to go into Closed
<br />Meeting pursuant to Virginia Code 2.2-3711, to discuss:
<br />• Appointments to boards and commissions, as per subsection 1
<br />• The performance of a city employee, as per subsection 1
<br />• Pending litigation, as per subsection 7, and
<br />• The protection of privacy of individuals in personal matters not related to public
<br />business, as per subsection 4
<br />The subjects of the meeting are appointments, personnel matters, the case of
<br />Ethel Weaver v. City of Portsmouth, and a personal matter involving a former city
<br />official.
<br />The purpose of the meeting is to discuss these matters in confidence so as to
<br />protect the interest of the city and the privacy of certain individuals.
<br />The motion was adopted by the following vote:
<br />Ayes: Cherry, Edmonds, Heretick, Moody, Randall, Whitehurst, Wright
<br />Nays: None
<br />Motion by Mr. Heretick, and seconded by Mr. Whitehurst, pursuant to Section
<br />2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members'
<br />knowledge during the immediately preceding Closed Meeting of the City Council:
<br />1. Only public business matters lawfully exempted from open meeting
<br />requirements by the Virginia Freedom of Information Act, and
<br />2. Only such public business matters as were identified in the motion, by which
<br />the Closed Meeting was convened, were heard, discussed or considered in
<br />the closed meeting just concluded by the City Council.
<br />The motion was adopted by the following vote:
<br />Ayes: Cherry, Edmonds, Heretick, Moody, Randall, Whitehurst, Wright
<br />Nays: None
