June 26, 2012 <br />At a Regular Meeting of the City Council on Tuesday, June 26, 2012, there were <br />present: <br />Mayor Kenneth I. Wright, Vice Mayor Charles B. Whitehurst, Sr., William E. Moody, Jr., <br />Marlene W. Randall, Stephen E. Heretick, Paige D. Cherry, Dr. Curtis E. Edmonds, Sr., <br />City Manager Kenneth L. Chandler, City Attorney G. Timothy Oksman. <br />Pastor Felton Whitfield opened the meeting with prayer, which was followed by <br />the Pledge of Allegiance to the Flag. <br />Mayor Wright called the meeting to order and welcomed all in attendance. <br />Motion by Mr. Moody, and seconded by Mr. Whitehurst, to approve the minutes <br />of a Called Meeting of June 11, 2012, a Called Meeting of June 12, 2012, and of a <br />Regular Meeting of June 12, 2012, and was adopted by the following vote: <br />Ayes: Cherry, Edmonds, Heretick, Moody, Randall, Whitehurst, Wright <br />Nays: None <br />- Unfinished Business - <br />12 - 239 -Use permit and comprehensive plan: <br />1. Mark Geduldig-Yatrofsky, P. O. Box 50141, spoke in support of this item. <br />Motion by Mr. Whitehurst, and seconded by Mr. Edmonds, to adopt the following <br />resolution approved on first reading at the June 12, 2012 meeting, and was adopted by <br />the following vote: <br />12-239(A): <br />"RESOLUTION GRANTING A USE PERMIT (UP-12-06) TO WHEELABRATOR <br />PORTSMOUTH, INC., TO INSTALL A SIGN AT THE CORNER OF ELM AVENUE <br />AND VICTORY BOULEVARD. <br />WHEREAS, Wheelabrator Portsmouth, Inc., has made application pursuant to <br />Section 40.1-5.11 E(6)(c) of the Code of the City of Portsmouth, Virginia (2006) for the <br />granting of a use permit to install a sign at the corner of Elm Avenue and Victory <br />Boulevard; and <br />WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br />WHEREAS, the Planning Commission has recommended the granting of the <br />application for a use permit with conditions. <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br />1. That it finds that the use for which the permit is sought: <br />(a) Complies with the applicable standards of the Zoning Ordinance; <br />(b) Is consistent with the comprehensive plan; <br />(c) Is compatible with the character of surrounding lands and the uses permitted in <br />the subject property's zoning district; <br />(d) Is configured to minimize adverse effects, including the visual impacts of the <br />proposed use on adjacent lands; <br />
