That the use for which the use permit is sought: <br /> <br /> (a) Will not affect the health and safety of persons <br />residing or working in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injuriol <br />to the property or improvements in the neighborhood; and <br /> <br /> (c) Will be in accord with the purposes of the Zoning <br />Chapter of the City Code. <br /> <br /> 2. The Bullock Corporation is hereby granted a use permit <br />pursuant to ~ 40-76 (b) of the Code of the City of Portsmouth, <br />Virginia, as amended, to operate a group home for adults on propert <br />located on the north side of West Norfolk Road, such property being <br />more particularly described as follows: <br /> <br />UP-87-15 <br /> <br /> BEGINNING at the northeastern right-of-way inter- <br />section of Cedar Lane and West Norfolk Road; thence <br />S 45° 27' 25" E, a distance of 98.09', to the point on <br />the northern right-of-way of West Norfolk Road; thence <br />along the northern right-of-way of West Norfolk Road <br />N 74° 45' o5" E, a distance of 197.93' to the True <br />Point of Beginning; thence N 2a 16' 21" W, a distance <br />of 344.66', to a point; thence N 89° 17' 33" E, a <br />distance of 241.19", to a point; thence S 1° 12' <br />27" W, a distance of 299.58', to a point on the northern <br />right-of-way of West Norfolk Road; thence along the <br />northern right-of-way of West Norfolk Road S 80° 32' <br />35' W, a distance of 118.92', to a point; thence along <br />the northern right-of-way of West Norfolk Road S 75° <br />45' 05" W, a distance of 107.68', to the True Point <br />of Beginning. <br /> <br /> 3. The use permit is approved subject to the following <br />:onditions: <br /> <br /> (a) The facility shall be limited to a maximum of sixty <br />(60) residents at any one time. <br /> <br /> (b) The applicant shall comply with all applicable codes, <br />ordinances, policies ~and regulations of red-eraS, state and local <br />governments.' <br /> <br />(h) <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO THE PORTSMOUTH <br />COMMUNITY SERVICES BOARD TO OPERATE A GROUP RESIDENCE <br />FOR SUBSTANCE ABUSE REHABILITATION AND TREATMENT AT <br />1000 GREEN STREET. <br /> <br /> WHEREAS, David M. Norman, Executive Director, Portsmouth <br />Community Services Board, has made application pursuant to g 40-121 <br />(a) of the Code of the City of Portsmouth, Virginia, as amended, fo <br />the granting of a use permit as hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all <br />things required to be done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting <br />of said use permit, with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1.
