October 13, 1987 UNFINISHED BUSINESS Consent Agenda On motion of Mrs. Webb and seconded by Mr. Simpson, the follow ing items approved on first reading at the Public Hearing of September 22, 1987, were adopted on final reading, and by the follo~ ing vote: 87-410 -Rezoning, group housing project, and use permit applications: (a) "ZONING AMENDMENT ORDINANCE Z 87-19." (b) "A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT PURSUANT TO SECTION 40-55 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, AS AMENDED SAID PROJECT BEING LOCATED ON 18 ACRES OF WATER- FRONT PROPERTY ON THE SOUTHERN PORTION OF THE FORMER BEASLEY FA~4 SITE AND CONSISTING OF 147 LOW-RISE AND 41 TOWN HOUSE CONDOMINIUMS SAID PROJECT BEING KNOWN AS CAMBRIA CALl AT RIVER POINTE AND DESIGNATED AS GHP-87-13. WHEREAS, Garcia-Gelardi Development Corporation by Earl J. New~ President of Newman Construction Corporation has made application )ursuant to Section 40-55 of the Code of the CiZy of Portsmouth, inia, 1973, as amended, for the granting and approval of a Group Housing Project consisting of 147 low-rise and 41 town house condominiums on i8 acres of waterfront property on the southern ~ortion of the former Beasley Farm and designated as GHP 85-15 such )arcel being more particularly described as parcel 2 in Zoning endment Ordinance Z 87-19; and WHEREAS, the application has been determined by the Planning Commission to have met the requirements of Section 40-55 of the Code of the City of Portsmouth, Virginia, i973, as amended; and F~EREAS, the Planning Commission has reviewed such application and site plans submitted therewith and has recommended conditional approval of said application; and WHEREAS, the developer has been informed that approval of a Group Housing Project pursuant to the Section 40-55 grants only m~exemption from certain requirements for residences as stated in said section and does not constitute a waiver of any other requiremen embodied in the Subdivision Ordinance, Zoning Ordinance, Code of the City of Portsmouth, Virginia, or any other applicable local, State or Federal law or regulation; and WHEREAS, the developer is aware that building permits or any other required permit will be issued only upon compli~n~ee with the ordinances, laws or regulations applicable thereto. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the certain Group Housing Project designated as GHP 87-13 entitled "Cambria Call at River Pointe" and being more specifically described in correspondence from Newman Construction Corporation dated August 14, 1987 as shown on plans entitled "River Pointe" filed with the appropriate officials of the City of Portsmouth, Virginia, such being made a part hereof, is hereby granted approval subject to the following terms and conditio~ 1. A landscape plan indicating more detail and treatment of parking area must be submitted to the Planning Staff for review and approval prior to the issuance of building permits. 2. A standard site improvement plan must be submitted to the Department of D~ngineering and technical Services for review and approval." an,
