<br />November 22. 2011 <br /> <br />1. City Council hereby makes a legislative finding and determination pursuant to <br />Section 2.01 of the Charter of the City of Portsmouth, Virginia that it is in the interest of <br />the safety, health, peace, good order, comfort, convenience, morals and welfare of all <br />citizens of the city for there to be Increased Participation. <br /> <br />2. City contracting is hereby determined to be one means that could contribute <br />to Increased Participation over a period of time. <br /> <br />3. The City Manager and the City Attorney are hereby authorized and directed to <br />develop and then implement a plan by which the City will work in all appropriate and <br />legal ways toward Increased Participation (the "Participation Plan"), to include but not <br />be limited to public contracting. These efforts shall be made with the clear <br />understanding that Increased Participation will not necessarily occur immediately, and it <br />will require a determined and patient commitment over a prolonged period of time. <br /> <br />4. The Participation Plan will be preceded by such studies as may be required <br />by law and as may be helpful in achieving the desired goal. It may include <br />recommended non-discriminatory ordinances, as authorized by Va. Code SS15.2-965.1 <br />and 2.2-4310. <br /> <br />5. The Participation Plan shall include consideration of good faith efforts by <br />contractors and potential contractors toward Increased Participation. <br /> <br />6. The Participation Plan may not entail discrimination against any contractor or <br />potential contractor on the basis of race, shall be within such boundaries and limits as <br />may be set by law, and shall not entail racial quotas. <br /> <br />7. The Participation Plan shall not compromise the goal of obtaining the best <br />possible goods and services at the lowest prices from qualified contractors. <br /> <br />8. All actions leading toward creation of the Participation Plan shall be <br />conducted in a financially prudent manner, including the award of any possible contract <br />or contracts related to studies. <br /> <br />9. The City Manager and the City Attorney shall report to City Council from time <br />to time about the status of their efforts pursuant to this resolution." <br /> <br />Ayes: Cherry, Edmonds, Heretick, Randall, Whitehurst, Wright <br />Nays: Moody <br /> <br />11 - 455 - Adoption of a resolution to commemorate and support the <br />bicentennial of the American War of 1812 in Virginia. Vision Principle: Bold New <br />Directions. <br /> <br />Background: <br />. The 200th anniversary of the American War of 1812 is approaching. The Virginia <br />Bicentennial Commission of the American War of 1812 has asked numerous Virginia <br />counties and cities to adopt resolutions in support of activities to commemorate the <br />bicentennial. <br /> <br />Discussion: <br />. The resolution expresses support for activities to commemorate the bicentennial. <br />. Some activities will be developed locally. <br />. Other activities will be developed statewide, and they will receive local support. <br /> <br />Financial Impact: <br />. No material financial impact can be reasonably predicted at this time. The City's <br />commitment to support commemoration activities is subject to the availability of <br />resources. <br />
