D~cember 8;"i987 <br /> <br />"A RESOLUTION GRANTING A USE~PERMIT TO THE J~MES CH.ISHOL~ <br />FOUNDATION TO OPERATE A TEMPORARY RESIDENCE FACILITY AT <br />313 GREEN STREET IN THE ASHLEY SQUARE'~CONDOMINIUM PROJECT. <br /> <br /> WHEREAS,' Mary Johnson, President of the James Chisholm <br />Foundation, has made application pursuant to [40-121 (a) (i) of <br />the Code cf the C'ity of Portsmouth, Virginia, as amended, for <br />~he granting of 'a ~se permit as hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done <br />all things required to be done in connection with said <br />application; and .~ · <br /> <br /> WHEREAS, the Planning Commission has recommen~ed.~the. ...... ~ <br />granting of said use permit, with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virg:~nia:' <br /> <br /> That the us~f~r which the use permit is sought: <br /> <br /> (a) Will ~not ~ffect the health and safety of persons <br /> or working ~iTf. the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or <br /> to the property or improvements in the neighborhood; <br /> <br />~esiding <br /> <br />injurious <br />and <br /> <br />Zoning <br /> <br /> (c) Will be in accordance with the purposes of the <br />Chapter of the City Code. · <br /> <br /> 2. The James Chisholm Foundation is hereby granted a use <br />permit pursuant to [40-121 (a) (i) of the Code of the City of <br />Portsmouth, Virginia, to operate a temporary residence facility <br />for sixteen (16) residents at 3.t~ .G~een Street in ~the Ashley <br />Square Condominium Project units 18, 19, 20, 21, 22, and 23 <br />(UP-87-25). <br /> <br /> 3. This use perm~it is approved subject to the following <br />conditions: <br /> <br /> ('a) No more than sixteen (16) residents can be <br />accommodated within the facility at any one time. <br /> <br /> (b) All singe a~d exterior chenges for the building must <br />be approved by the Downtown Design~Co~mittee. <br /> <br /> (c) Any changes to the interior must be submitted to the <br />Planning Department staff for review and approval. <br /> <br /> (d) The appli'cant shall comply with all appl~abi~ <br />codes, ordinances, policies and regulations of feder&l, state <br />and local governments and shall obtain all necessary licenses <br />and permits. <br /> <br /> (e) A minimum of six (6) on-site parking spaces must be <br />provided." <br /> <br /> Ayes: Barnes, Corprew, Gray, Lucas, Simpson, Webb, Holley <br /> Nays: None <br /> <br /> 87-501 - The following ordinance approved on first readin~ <br />at the regular meeting of November 24, 1987 ~as taken up and <br />read: <br /> <br /> <br />
