April 26, 1988 Z 88-2 TRUXTON NEIGHBORHOOD - Rezontng permit applications for Wesley H. Frye, owner and lessee, and the City of Portsmouth, to rezone property at 3409 Deep Creek .Boulevard from Commercial C-1 and Residential R-75 to' Commercial C-2-K Conditional, to allow for a service station garage and an automobile storage yard, approved at the Public of April 11, 1988, was taken up and read. On motion~of.'Mr. Barnes and~ seconded-by,Mr. Simpson~ the following ordinance was adopted on final reading, and was adopted by the following vote: - "ZONING AMENDMENT ORDINANCE Z 88r2" Ayes: Nays: Barnes, Corprew, Williams, Webb None Lucas, Simpson, Motion of Mr. Barnes and seconded following resolution approved on first by the following vote: by Mr. Simpson, the reading was adopted, and "A RESOLUTION GRANTING A USE PERMIT TO WESLEY FRYE TO OPERATE AN AUTOMOBILE STORAGE YARD AT 3409 DEEP CREEK BOULEVARD. WHEREAS, Wesley Frye has.made application pursuant to ~40-71 (b) of the Code of the City of Portsmouth, Virginia, amended, for the~gran~ing of a ~§e permit as hereinafter-described; and as WHEREAS, the Planning Director have in connection with said application; and %P the applicant and W~EREAS, the Planning Commission has recommended granting of said use permit, with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of of Portsmouth, Virginia: the done the City 1. That the use for which the use permit is sought: (a) Will not affect the healthand safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property and improvements in the neighborhood; and (c) Will be in accord with the purposes of the Zoning Chapter of the City Code. 2. Wesley Frye is hereby granted a use permit pursuant to ~40-71 (b) of the Code of the City of Portsmouth, Virginia to operate an automobile storage yard at 3409 Deep Creek Boulevard and certain city owned property adjacent thereto, such properties being more specifically described as Tax Map 473, Parcel 1 and .396 acres on Tax Map 151, ~Parcel 3 (UP-88-1), such parcels being designated as Parcel 1 and Parcel 2 and being more particularly described as follows:
