<br />Mav 25. 2011 <br /> <br />At a Regular Meeting of the City Council on Wednesday, May 25, 2011, there <br />were present: <br /> <br />Mayor Kenneth I. Wright, Vice Mayor Charles B. Whitehurst, Sr., William E. Moody, Jr., <br />Marlene W. Randall, Stephen E. Heretick, Paige D. Cherry, Dr. Curtis E. Edmonds, Sr., <br />City Manager Kenneth L. Chandler, City Attorney G. Timothy Oksman. <br /> <br />Councilman Curtis E. Edmonds, Sr., opened the meeting with prayer, which was <br />followed by the Pledge of Allegiance to the Flag. <br /> <br />Mayor Wright called the meeting to order and welcomed all in attendance. <br /> <br />Motion by Mr. Whitehurst, and seconded by Mr. Heretick, to approve the minutes <br />of a Called Meeting of May 10, 2011, and of a Regular Meeting of May 10, 2011, and <br />was adopted by the following vote: <br /> <br />Ayes: Cherry, Edmonds, Heretick, Moody, Randall, Whitehurst, Wright <br />Nays: None <br /> <br />11 - 208 - Presentation: <br /> <br />. Special presentation of Leadership Certificates from Virginia First Cities to <br />Councilwoman Marlene Randall and City Manager Kenneth Chandler. <br /> <br />- Unfinished Business - <br /> <br />Consent Aqenda: <br /> <br />11 - 184 - Use permits: <br /> <br />Motion by Mr. Heretick, and seconded by Mr. Moody, to adopt the following <br />resolutions approved on first reading at the May 10, 2011 meeting, and was adopted by <br />the following vote: <br /> <br />11 -1 84 (a): <br /> <br />"RESOLUTION GRANTING A USE PERMIT TO THE REBKEE COMPANY TO <br />OPERATE A PHARMACY OR DRUG STORE WITH DRIVE-THROUGH FACILITY AT <br />3555 AIRLINE BOULEVARD. <br /> <br />WHEREAS, The Rebkee Company has made application pursuant to Section <br />40.1-2.3 B of the Code of the City of Portsmouth, Virginia (2006) for the granting of a <br />use permit for the operation of a pharmacy or drug store with drive-through facility at <br />3555 Airline Boulevard, Portsmouth, Virginia; and <br /> <br />WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended the granting of the <br />application for a use permit with conditions. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That it finds that the use for which the permit is sought: <br /> <br />(a) Complies with the applicable standards of the Zoning Ordinance; <br /> <br />(b) Is consistent with the comprehensive plan; <br /> <br />(c) Is compatible with the character of surrounding lands and the uses permitted in <br />the subject property's zoning district; <br />
