May 10. 2011 Financial Impact: . Funds will be available for undertaking the priorities established by the 5-Year CP and in agreement with the statutory purposes of the CDBG and HOME programs. . There is no matching fund requirement for CDBG funds. HOME funds require a match contribution of not less than 12.5% of the HOME funds drawn. Staff Recommends: . Adoption of the FY2012 Annual Action Plan and to authorize the City Manager to submit the plan to HUD. . Adoption of the proposed ordinance appropriating said funds to the 2012 budget. Next Steps Following Council Action: . The Annual Action Plan will be submitted to HUD by May 15, 2011. HUD will then have a 45-day comment period and the FY2012 Program Year will start on July 1, 2011. Motion by Mr. Heretick, and seconded by Mr. Edmonds, to adopt the following resolution, and was adopted by the following vote: "RESOLUTION APPROVING THE COMMUNITY PLANNING AND DEVELOPMENT 2012 ACTION PLAN OF THE CITY OF PORTSMOUTH, VIRGINIA, AND AUTHORIZING THE CITY MANAGER TO FILE DOCUMENTS REQUIRED TO OBTAIN THE CITY'S COMMUNITY PLANNING AND DEVELOPMENT GRANT ENTITLEM ENTS. WHEREAS, pursuant to the Housing and Community Development Act of 1974, as amended, and the Cranston - Gonzalez National Affordable Housing Act of 1992, as amended, ("Acts"), financial assistance is provided to enable localities to provide decent housing, establish and maintain suitable living environments, and expand economic opportunities for low to moderate income residents; and WHEREAS, each of the Community Planning and Development programs (Community Development Block Grant and Home Investment Partnerships) shall be operated on a single consolidated program year; and WHEREAS, the required public hearing has been held and the City Council has reviewed the proposed 2012 Action Plan ("2012 Action Plan"); and WHEREAS, it is necessary that this Council take official action regarding the 2012 Action Plan to comply with the regulations of the aforementioned Acts; and WHEREAS, this Council is aware of the federal regulations governing the undertaking and carrying out of activities under the community planning and development programs; and WHEREAS, this Council recognizes its responsibility to direct that safeguards be established to protect employees from using their positions for a purpose that gives the appearance of being motivated by a desire for private gain for themselves or others, particularly those with whom they have family, business or other ties; and WHEREAS, this Council has found that the proposed 2012 Action Plan IS appropriate to meet the needs of the City and, therefore, is acceptable. NOW THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the proposed 2012 Action Plan having been reviewed and considered, said Plan be and hereby is approved as final in all respects, and the City Manager is hereby authorized to file any additional information as may be required with the Department of Housing and Urban Development in order to obtain funding for the programs addressed in the Plan.
