: 09 <br /> <br />May 24, 1988 <br /> <br /> BE IT FURTHER RESOLVED that the adoption of this Resolution <br />does not constitute an endorsement of the Bonds to prospective <br />purchasers of the Bonds, the financial viability of the Facility <br />or the credit worthiness of the Company, and the Bonds shall <br />provide'that neither the Commonwealth of Virginia, City of <br />Portsmouth, nor PRHA shall he obligated to pay the Bonds or the <br />interest thereon or the costs incident thereto except from the <br />revenues and monies pledged therefor, and neither the faith nor <br />the credit nor the taxing power of the Commonwealth, the City nor <br />PRHA shall be pledged thereto. <br /> <br /> This Resolution shall taka effect immediately upon its <br />adoption." <br /> <br />Ayes: Barnes, Corprew, Gray, Lucas, Simpson, Williams, Webb <br />Nays: None <br /> <br /> 88-208 - Letter form the City manager recommending adoption <br />of a resolution to appoint viewers for closing a portion of <br />Avondale Road. <br /> <br /> "The City of Portsmouth has made application to vacate~ <br />and discontinue a portion of High Point Road. The Notice of <br />Application and Request for Appointment of Viewers has been <br />advertised. <br /> <br />close <br /> <br /> I recommend adoption of the resolution appointiqg viewers for <br />this application." <br /> <br /> On motion of Mrs. Lucas and seconded by Mr. Simpson, the <br />following resolution was adopted, and by the following vote: <br /> <br />"A RESOLUTION APPOINTING VIEWERS FOR CLOSING A PORTION OF <br />HIGH POINT ROAD. <br /> <br /> WHEREAS, the City of Portsmouth has made application to <br />vacate, close and discontinue the hereinafter-described portion of <br />High Point Road~ and it appearing that Notice of Application and <br />Request for Appointment of Viewers has been advertised as required <br />by law. <br /> <br /> NOW, THEREFOREf BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia, that Richard D.'Ottavio, Charles Hudgins, <br />Robert Reed, Harrison Miller, and Moses Gibson be appointed <br />viewers and'that Casey Lavender and-Harry Hopewell, be appointed <br />alternate viewers in the event one of the preceding viewers fails <br />to participate, said viewers to view the hereinafter-described <br />portion of such street and to report to this Council in writing <br />whether in their opinion any, and if any what, inconvenience would <br />result in vacating and closing~the following: <br /> <br /> All"that certain strip of land, situat~ in the City of <br />Portsmouth, Virginia and being that portion of High Point Drive as <br />shown on the Plat of Pinehurst, Section One, duly recorded in the <br />Clerk's Office of the Circuit Court of the City of Chesapeake, <br />Virginia, in Map Book 22, page 93 as follows to-wit: beginning at <br />a point on the southern side of High Point Drive at the <br />southeastern corner of Lot 32 as shown on the Plat of Pinehurst, <br />Section One; thence running in a northerly direction along the <br />eastern boundary of Lot 32 a distance of 25 feet to a point; <br />thence running east 50 feet to a point on the western boundary of <br />Lot 19; thence running in a southerly direction along the western <br />boundary of Lot 19 a distance of 25 feet to a point on the <br />northern boundary of High Street; thence running easterly along <br />the northern boundary of High Street a distance of 50 feet to the <br />Point of Beginning." <br /> <br />Ayes: Barnes, Corprew, Gray, Lucas, Simpson, Webb, Williams <br />Nays: None <br /> <br /> <br />
