<br />March 22. 2011 <br /> <br />(d) Is configured to minimize adverse effects, including the visual impacts of the <br />proposed use on adjacent lands; <br /> <br />(e) Avoids significant deterioration of water and air resources, and other natural <br />resources; <br /> <br />(f) Maintains safe and adequate egress and ingress onto the site and safe road <br />conditions around the site; <br /> <br />(g) Allows for the protection of property values and the ability of neighboring lands to <br />develop the uses permitted in their zoning district(s); <br /> <br />(h) Complies with all other city, state, and federal laws and regulations. <br /> <br />2. That Moses David, Jr., is hereby granted a use permit pursuant to Section <br />40.1-2.3B of the Code of the City of Portsmouth, Virginia (2006) for the operation of an <br />entertainment establishment at 2513-A Victory Boulevard, Portsmouth, Virginia. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicants and any successor in interest: <br /> <br />(a) Landscaped islands shall be installed and the general site layout shall be in <br />accordance with the Use Permit Plan dated January 24, 2011 prepared by Land Design <br />& Development, Inc. <br /> <br />(b) An opaque vegetative screen shall be established along the northern boundary of <br />the parking area between the parking area and the existing ditch along Victory <br />Boulevard. The screen shall consist of shrubs that are a minimum of 36" alternating <br />with small trees. The new islands proposed shall also be landscaped in accordance <br />with the ordinance requirements. The landscaping plan shall be approved by the <br />Planning Director, including arrangements to ensure that the landscaping is installed. <br /> <br />(c) The parking overnight or storage of heavy trucks and vehicles between the <br />building (areas A through D on the Use Permit Plan dated October 28, 2010) and <br />Victory Boulevard shall be prohibited. <br /> <br />(d) The occupant load for the Renaissance Performing Arts Center lease space, as <br />contained in this application (designated on the Use Permit Plan as Area A), shall be <br />limited to 500 people, or less as determined by the Building Official. The occupancy <br />load shall not be exceeded at any time. <br /> <br />(e) The days and hours of operation shall be limited to Monday through Thursday, <br />10:00 a.m. to 9:00 p.m. and Friday and Saturday 10:00 a.m. to 11 :00 p.m. <br /> <br />(f) Sufficient interior and exterior security shall be provided as needed by individuals <br />who are certified by the Virginia Department of Criminal Justice Services. <br /> <br />(g) Noise from the entertainment establishment shall not be audible at the property <br />line and all entertainment activities shall be conducted inside the building. <br /> <br />(h) The establishment shall be operated and maintained as a drug free zone and the <br />sale or use of alcoholic beverages shall be prohibited in the portion of the building <br />occupied by the Performing Arts Center (designated on the Use Permit Plan as Area A). <br /> <br />(i) All new free standing signs shall conform to the NMU district standards <br />established in the Zoning Code. <br /> <br />(j) All uses on the property shall be operated in compliance with all applicable <br />codes, ordinances, and regulations of federal, state, and local governments. <br />
