<br />At a Regular Meeting of the City Council on Tuesday, September 28, 2010, there
<br />were present:
<br />
<br />Mayor Bernard D. Griffin, Sr., Vice Mayor Charles B. Whitehurst, Sr., William E. Moody,
<br />Jr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psimas, Paige D. Cherry,
<br />City Manager Kenneth L. Chandler, City Attorney G. Timothy Oksman.
<br />
<br />Pastor Charles Kelly opened the meeting with prayer, which was followed by the
<br />Pledge of Allegiance to the Flag.
<br />
<br />Mayor Bernard D. Griffin, Sr., called the meeting to order and welcomed all in
<br />attendance.
<br />
<br />Motion by Mr. Whitehurst, and seconded by Mr. Moody, to approve the minutes
<br />of a Called Meeting of September 14, 2010, of a Regular Meeting of September 14,
<br />2010, and of a Called Meeting of September 21, 2010, and was adopted by the
<br />following vote:

<br />Ayes: Cherry, Heretick, Moody, Psi mas, Randall, Whitehurst, Griffin
<br />Nays: None

<br />- Public Hearing -
<br />
<br />10 - 445 - Public hearing on a floodplain management plan application:
<br />
<br />FPM-10-01 CITY WIDE - The City of Portsmouth seeks approval of a Floodplain
<br />Management Plan that identifies tidal flooding issues and makes
<br />recommendations to assist in determining citizens and properties at risk
<br />status, reducing flood damages and reducing recovery time after a
<br />flooding event. Vision Principle: Bold New Directions.
<br />
<br />1. Mark Geduldig-Yatrofsky, P. O. Box 50141, spoke in support of this item.
<br />
<br />Motion by Mr. Heretick, and seconded by Mr. Moody, to concur with the
<br />recommendation of the Planning Commission that FPM-10-01 be approved on first
<br />reading, and was adopted by the following vote:

<br />Ayes: Cherry, Heretick, Moody, Psi mas, Randall, Whitehurst, Griffin
<br />Nays: None

<br />10 - 418 - Use permit:
<br />
<br />Motion by Mr. Whitehurst, and seconded by Mr. Moody, to adopt the following
<br />resolution approved on first reading at the September 14, 2010 meeting, and was
<br />adopted by the following vote:

<br />"RESOLUTION GRANTING A USE PERMIT TO HOLY COMMUNION LUTHERAN
<br />CHURCH TO OPERATE A CHILD CARE CENTER AT 6220 PORTSMOUTH
<br />BOULEVARD.
<br />
<br />WHEREAS, Holy Communion Lutheran Church has made application pursuant
<br />to Section 40.1-2.3 B of the Code of the City of Portsmouth, Virginia (2006) for the
<br />granting of a use permit for the operation of a child care center at 6220 Portsmouth
<br />Boulevard, Portsmouth, Virginia; and
<br />
<br />WHEREAS, the applicant and the Planning Director have done all things
<br />required to be done in connection with said application; and
