<br />September 28. 2010 <br /> <br />Next Steps Following Council Action: <br />. Conduct due diligence. <br />. If there is a positive outcome from due diligence, negotiate a legally binding sale <br />and development agreement. <br />. Then, if the transaction meets with the approval of City Council, Council will <br />authorize conveyance of the property to PRHA to implement the project. There must be <br />an acceptable plan for replacement of the recreation center prior to conveyance of the <br />Cradock High School property to the Developer. <br /> <br />1. Joanna Hall, 92 Nicholson Street, spoke in support of this item but asked that a <br />replacement to the current recreational facility be provided for the community prior to <br />beginning the development. <br /> <br />Motion by Ms. Psi mas, and seconded by Mr. Heretick, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"RESOLUTION AUTHORIZING A MEMORANDUM OF INTENT WITH CRADOCK <br />PROPERTIES, LLC FOR DEVELOPMENT OF THE FORMER CRADOCK HIGH <br />SCHOOL SITE. <br /> <br />BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That the City Manager is hereby authorized and directed to execute and <br />deliver a Memorandum of Intent substantially the same as that which is attached hereto, <br />for the purpose of facilitating residential development of the former Cradock High <br />School site. The developer shall be Cradock Properties, LLC. <br /> <br />2. The City Manager and City Attorney shall take all steps reasonably necessary <br />to implement the intent of this resolution, and they shall report to City Council from time <br />to time about the status of the matter." <br /> <br />Ayes: Cherry, Heretick, Moody, Psi mas, Randall, Whitehurst, Griffin <br />Nays: None <br /> <br />10 - 454 - Adoption of a resolution establishing the William B. Spong, Jr. Charter <br />Review Commission and appointing members thereto. <br /> <br />Background: <br />. The Portsmouth City Charter has not a comprehensive review and update for <br />many years. As a result, it still contains numerous sections that are out of date, illegal, <br />dysfunctional, and/or no longer needed. <br /> <br />Discussion: <br />. This resolution would create a "blue ribbon" commission of citizens to review the <br />charter and recommend improvement and modernization. <br />. The commission will review the charter, receive professional advice, and <br />ultimately submit a written report with recommendations to City Council. <br />. All meetings of the commission will be public, and the commission may also <br />receive and consider written comments and suggestions from citizens. <br />. After City Council receives the commission's report, it will conduct a public <br />hearing and then ask our delegation to the General Assembly to submit a charter bill. <br />. There are several key topics involving public policy decisions that will not be <br />dealt with by the commission, and that are reserved solely for City Council to decide. <br /> <br />Financial Impact: <br />. There will be no material financial impact. <br /> <br />Recommended Action: <br />. Adoption of the resolution IS recommended. Vision Principle: Bold New <br />Directions. <br />
