January 10, 1989 <br /> <br /> WHEREAS, Gary E. Adamsr Regional Real Estate Manager for <br />Kinder-Care Learning Centers, Inc., has made application pursuant <br />to ~40-71 (b) of the Code of the City of Portsmouth, Virginia, <br />1973, for the granting of a use permit to operate a child-care <br />center adjacent to the Academy Crossing Shopping Center on <br />Churchland Boulevard; and <br /> <br /> WHEREAS, the applicant~and <br />all things required to be done <br />application; and <br /> <br />the Planning Director have done <br />in connection with said <br /> <br /> WHEREAS, the Planning Commission has recommended the <br />conditional granting of a use permit for the operation of <br />child-care center. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That the use for which the use permit is sought: <br /> <br /> (a) Will not adversely affect the health and safety of <br />persons residing or working in the neighborhood of the proposed <br />use; <br />(b) Will not be detrimental to the public use or <br />in3urious to the property or improvements of the neighborhood; <br /> <br /> (c) Will be in accordance with the purposes of the <br />Zoning Chapter of the City Code. <br /> <br /> 2. Kinder-Care Learning Centers, Inc. is hereby granted a usc <br />permit pursuant to ~40-71 (b) of the Code of the City of <br />Portsmouth, Virginia, 19!73, to operate a child-care center <br />adjacent to the Academy Crossing Shopping Center on Churchland <br />Boulevard, such property being more particularly described as <br />follows: <br /> <br />UP-88-16 <br /> <br /> BEGINNING at an old iron pin in the <br />southern right-of-way line of Churchland <br />Boulevard at the common corner of the herein <br />described parcel and the tract of land <br />presently owned by the Churchland Baptist <br />Church; thence leavin~ said beginning point <br />and running along said right-of-way line S 69° <br />40' 43" E 63.82 feet to a concrete monument at <br />the beginning of a curve to the left having a <br />radius of 897.49 feet; thence continuin] along <br />said right-of-way along said curve to the left <br />an arc distance of 124.05 feet to an iron pin <br />at the common corner with parcel 2 of the <br />subdivision qf Academy Crossing; thence <br />leaving saidroad right-of-way and running <br />along the common division line with parcel 2 S <br />7° 12' 08" W 139.78 feet to an iron pin; <br />thence N 82° 47' 52" W 184.52 feet to an iron <br />pin at the cQmmon corner of the herein <br />described pa~cel, said parcel 2 and the <br />aforementioned church tract; thence leaving <br />parcel 2 and running along the line of said <br />church tract N 7° 12' 08" E 174.00 feet to the <br />place of beginning containing 28,500 square <br />feet or 0.65427 acres. <br /> <br /> <br />
