January 10, 1989 WHEREAS, Gary E. Adamsr Regional Real Estate Manager for Kinder-Care Learning Centers, Inc., has made application pursuant to ~40-71 (b) of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a use permit to operate a child-care center adjacent to the Academy Crossing Shopping Center on Churchland Boulevard; and WHEREAS, the applicant~and all things required to be done application; and the Planning Director have done in connection with said WHEREAS, the Planning Commission has recommended the conditional granting of a use permit for the operation of child-care center. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or in3urious to the property or improvements of the neighborhood; (c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. 2. Kinder-Care Learning Centers, Inc. is hereby granted a usc permit pursuant to ~40-71 (b) of the Code of the City of Portsmouth, Virginia, 19!73, to operate a child-care center adjacent to the Academy Crossing Shopping Center on Churchland Boulevard, such property being more particularly described as follows: UP-88-16 BEGINNING at an old iron pin in the southern right-of-way line of Churchland Boulevard at the common corner of the herein described parcel and the tract of land presently owned by the Churchland Baptist Church; thence leavin~ said beginning point and running along said right-of-way line S 69° 40' 43" E 63.82 feet to a concrete monument at the beginning of a curve to the left having a radius of 897.49 feet; thence continuin] along said right-of-way along said curve to the left an arc distance of 124.05 feet to an iron pin at the common corner with parcel 2 of the subdivision qf Academy Crossing; thence leaving saidroad right-of-way and running along the common division line with parcel 2 S 7° 12' 08" W 139.78 feet to an iron pin; thence N 82° 47' 52" W 184.52 feet to an iron pin at the cQmmon corner of the herein described pa~cel, said parcel 2 and the aforementioned church tract; thence leaving parcel 2 and running along the line of said church tract N 7° 12' 08" E 174.00 feet to the place of beginning containing 28,500 square feet or 0.65427 acres.
