<br />July 27.2010 <br /> <br />"ORDINANCE ACCEPTING A GRANT IN THE AMOUNT OF $572,829 FROM THE <br />VIRGINIA DEPARTMENT OF CRIMINAL JUSTICE SERVICES AND <br />APPROPRIATING SAID AMOUNT IN THE FY 2010-2011 GRANTS FUND TO <br />PROVIDE FUNDING TO OPERATE LOCAL PROBATION AND PRETRIAL <br />SERVICES IN THE CITY OF PORTSMOUTH." <br /> <br />Ayes: Cherry, Heretick, Moody, Psi mas, Randall, Whitehurst <br />Nays: None <br /> <br />10 - 356 - Adoption of an ordinance to prohibit the roadside solicitation of funds or the <br />sale of goods or services. Vision Principle: Thriving Neighborhoods and a Sense of <br />Community. <br /> <br />Background: <br />. The solicitation of funds and the requesting that drivers purchase goods or <br />services by pedestrians at road intersections, particularly at stoplights, has become an <br />increasing annoyance to drivers and a danger to the pedestrians. <br />. Because of state statute that only authorized certain localities (not including <br />Portsmouth) to regulate or prohibit such activities, the City has been prevented from <br />directly addressing the issue. <br />. City Code Section 32-29 has prohibited live advertising for the purpose of <br />soliciting political support or the purchase of goods or services, and the recently <br />enacted City Code Section 22-702.1 prohibited pedestrians from remaining in a street <br />for more time than reasonably necessary to cross the street. <br />. The 2010 General Assembly amended the state code to allow all localities to <br />regulate or prohibit the roadside solicitations effective July 1, 2010. <br />. The new state law makes the offense punishable as a traffic infraction punishable <br />by a fine not to exceed $250. <br /> <br />Discussion: <br />. This ordinance will eliminate the hazardous and annoying situations created by <br />the roadside solicitation of contributions or the purchase of goods or services. <br /> <br />Financial Impact: <br />. There will be no financial impact on the City. <br /> <br />Staff Recommends: <br />. Adoption of an ordinance to amend the City Code by adopting a new Section 22- <br />18 to prohibit roadside solicitations and to repeal Section 32-29 which has been <br />preempted by the action of the General Assembly. Vision Principle: Thriving <br />Neighborhoods and a Sense of Community. <br /> <br />Next Steps Following Council Action: <br />. The Police Department will be responsible for enforcement of the new ordinance. <br /> <br />Motion by Ms. Psi mas, and seconded by Mr. Heretick, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA <br />(2006) BY ADOPTING A NEW SECTION 22-18 THERETO AND BY AMENDING <br />SECTION 32-29 THEREOF PERTAINING TO SOLICITATION OF CONTRIBUTIONS <br />AND SALE OF MERCHANDISE OR SERVICES ON PUBLIC STREETS." <br /> <br />Ayes: Cherry, Heretick, Moody, Psi mas, Randall, Whitehurst <br />Nays: None <br /> <br />10 - 357 - Adoption of a resolution to approve the FY 2010-2011 Performance Contract <br />for the Department of Behavioral Healthcare Services.
