April 25, 1989 <br /> <br /> WHEREAS, Basil F. Gray, III and Phillip M. Gray have made <br />application pursuant to ~40-102 (B) of the Code of the City of <br />Portsmouth, Virginia for a use permit to convert an existing <br />single-family residence to a duplex residence at 106 London <br />Boulevard (Tax Map 2, Parcel 8) which is located in the-Olde <br />Towne Historic Distriot; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done <br />all things required to be done in connection with said <br />application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the <br />granting of a ~Se permit, with conditions, for the conversion <br />an existing single-family dwelling to a duplex residential <br />structure. <br /> <br />of <br /> <br /> NOW, -THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br />1. That the use for which the use permit is sought: <br /> <br /> (a) Will not adversely affect the health and safety <br />of persons residing in the .neighborhood of the proposed use; <br /> <br />injurious <br />and~ <br /> <br /> (b) Will not be detrimental to the public use or <br />to the property or improvements in the neighborhood; <br /> <br /> (c) Will be in accord with the purposes of the <br />Zoning Cha~ter of the City Code. <br /> <br /> 2. Basil F. Gray, III and Phillip M. Gray are hereby <br />granted a use permit pursuant to ~40-102 (B) to convert an <br />existing single-family residence to a duplex residential <br />structure at 106 London Boulevard, such conversion to be in <br />compliance with the regulations applicable to the Olde Towne <br />Historic Residential District as provided for in the Zo~ning <br />Chapter of the Code of the.City of Portsmouthf Virginia, 1973, <br />as amended, such approval being granted subject to the following <br />terms and conditions: <br /> <br /> (a) The applicant shall comply with all applicable <br />codes, ordinances, policies and regulations of the City of <br />POrtsmouth, Virginia', and shall obtain all necessary licenses <br />and permits. <br /> <br /> (b) The owners of the property must sign an <br />encroachment agreement approved by the City Attorney for the <br />City of Portsmouth, Virginia prior to the issuance of the <br />Certificate of Occupancy." <br /> <br /> 89-144 "AN ORDINANCE TO APPROPRIATE $100,000. FROM THE <br />cAPITAL IMPROVEMENT FUND FOR MISCELLANEOUS REPAIRS AND <br />RENOVATIONS TO PORTSMOUTH PUBLIC SCHOOL FACILITIES." <br /> <br /> 89-145 "AN ORDINANCE TO APPROPRIATE $111,000. FROM THE <br />PUBLIC UTILITIES CAPITAL IMPROVEMENT FUND FOR THE GEORGE <br />WASHINGTON HIGHWAY UTILITIES PROJECT, PHASE I." <br /> <br />Ayes: Barnes Corprew, Gray, Hawks, Lucas, Simpson, Webb <br />Nays: None <br /> <br /> <br />
