Good Neighbor Agreements are to be signed by City Manager and City Attorney <br />and delivered in escrow to SPSA, pending closing on the sale to Wheelabrator. <br />. Once closing occurs, the Agreements will become effective. <br />. Within thirty days of closing, SPSA will pay $850,000 to Portsmouth. <br /> <br />1. Joanna Hall, 92 Nicholson Street, spoke in support of this item. <br /> <br />Motion by Mr. Heretick, and seconded by Mr. Whitehurst, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE CONCERNING TWO GOOD NEIGHBOR AGREEMENTS, ONE WITH <br />THE SOUTHEASTERN PUBLIC SERVICE AUTHORITY OF VIRGINIA AND THE <br />OTHER WITH WHEELABRATOR PORTSMOUTH INC., AND ALSO AUTHORIZING <br />CONVEYANCE OF CERTAIN REAL ESTATE." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />10 - 177 - Adoption of a resolution authorizing the City Manager to vacate an existing <br />utility easement in exchange for a new utility easement in the City of Suffolk for use by <br />the Department of Utilities. Vision Principle: Bold New Directions and a Robust and <br />Prospering Economy. <br /> <br />Background: <br />. The City has an existing 20 foot wide utility easement that extends from Lake <br />Cohoon to a point at Lake Meade near the Lake Kilby Water Treatment Plant. This <br />easement crosses a parcel located at the junction of Pitchkettle Road and US58 Bypass <br />that is proposed to be developed into a residential subdivision. <br />. The existing easement does not currently have an active pipeline. It could <br />possibly be used for a raw water line from a proposed emergency pump station at Lake <br />Cohoon. The City is currently conducting a study to determine the best pump station <br />design and pipeline route for this project. <br />. The existing easement traverses the middle of this parcel causing a hindrance to <br />the developer. The developer has proposed granting a new utility easement to the City <br />in exchange for vacating the existing easement. <br /> <br />Discussion: <br />. The existing parcel is open farmland which would allow for easy installation of a <br />new pipeline. However, having it developed into a residential subdivision would cause <br />the installation and maintenance of a new pipeline to be significantly more costly and <br />difficult. This residential subdivision is expected to be constructed first. <br />. The new easement being proposed would allow the City two options of routing <br />the new pipeline, either along Pitchkettle Road or through other adjacent City-owned <br />property. <br />. The new easement will be outside of the developed areas of the subdivision <br />allowing for less costly and easier installation and long-term maintenance. <br /> <br />Financial impact: <br />. No City funds are involved. There is no cost for the new easement. <br /> <br />Recommended Action: <br />. Adoption of the resolution.
