<br />At a Called Meeting of the City Council on Tuesday, January 26, 2010, there
<br />were present:
<br />
<br />Mayor James W. Holley III, *Vice Mayor William E. Moody, Jr., Charles B. Whitehurst,
<br />Sr., Marlene W. Randall, *Stephen E. Heretick, Elizabeth M. Psimas, Douglas L. Smith,
<br />City Manager Kenneth L. Chandler, City Attorney G. Timothy Oksman.
<br />
<br />10 - 38 - The following call for the meeting was read:
<br />
<br />"Please attend a Called Meeting of the City Council to be held in the 6th Floor
<br />Conference Room, 801 Crawford Street, 6:00 p.m., Tuesday, January 26,2010 for the
<br />purpose of a Public Work Session.
<br />
<br />In addition, you may consider a motion to go into a Closed Meeting.
<br />
<br />By order of the Mayor."
<br />
<br />1 0 - 39 - Motion by Ms. Psi mas, and seconded by Mr. Whitehurst, to go into Closed
<br />Meeting pursuant to provisions of Section 2.2-3711 (A) of the Code of Virginia, to
<br />discuss appointments to boards and commissions, as per subsection 1, the purchase of
<br />real estate for a public purpose and the sale of publicly owned real estate, as per
<br />subsection 3, and also for matter requiring the advice of legal counsel, including
<br />discussion of pending litigation, as per subsection 7.
<br />
<br />The subjects of the meeting are:
<br />
<br />. a possible property exchange with Zion Baptist Church,
<br />. an appointment to the Southeastern Public Service Authority (SPSA) Board of
<br />Directors
<br />. the legal documents related to management of the Portsmouth Renaissance Hotel
<br />and Conference Center, and
<br />. pending litigation involving municipal revenues
<br />
<br />The purpose of the meeting is to permit the confidential discussion of appointees,
<br />and also discussion of strategy in matters involving the financial interests of the City.
<br />
<br />The motion was adopted by the following vote:
<br />
<br />Ayes: Psimas, Randall, Smith, Whitehurst, Holley
<br />Nays: None
<br />
<br />Motion by Ms. Psi mas, and seconded by Mr. Whitehurst, pursuant to Section 2.2-
<br />3712(0) of the Code of Virginia, certifying that to the best of the Council Members'
<br />knowledge during the immediately preceding Closed Meeting of the City Council:
<br />
<br />1. Only public business matters lawfully exempted from open meeting
<br />requirements by the Virginia Freedom of Information Act, and
<br />
<br />2. Only such public business matters as were identified in the motion, by which
<br />the Closed Meeting was convened, were heard, discussed or considered in
<br />the meeting by the City Council.
<br />
<br />The motion was adopted by the following vote:

<br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley
<br />Nays: None
