<br />November 24. 2009 <br /> <br />(e) Will be In accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br />2. That a use permit is hereby granted pursuant to Section 40-43.1 of the <br />Code of the City of Portsmouth, Virginia (2006) to operate church at 812 Washington <br />Street, Portsmouth, Virginia, and being more particularly described as: <br /> <br />UP-09-13 <br /> <br />Beginning at a the point of intersection between the western line of Washington Street <br />and the northern line of South Street, thence proceeding 147 feet more or less along <br />the northern line of South Street to a point, thence turning northwardly and proceeding <br />113 feet more or less to a point, thence proceeding westwardly 33 feet more or less to a <br />point, thence proceeding northwardly 116 feet more or less to a point in the southern <br />line of Columbia Street, thence proceeding eastwardly along the southern line of <br />Columbia Street 181 feet more or less to a point being the point of intersection between <br />the western line of Washington Street and the southern line of Columbia Street, thence <br />southwardly along the western line of Washington Street 229 feet more or less to the <br />point of beginning. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) Prior to site plan approval, a subdivision plat must be recorded which creates a <br />single parcel of land and vacates all internal lot lines. <br /> <br />(b) Approval of final development, including a landscaping plan, must be obtained <br />from Downtown Design Committee. <br /> <br />(c) Hours of operation are approved for 24 hours seven, days a week. <br /> <br />(d) Site Plan approval must be obtained. <br /> <br />(e) Private Trash Hauler and pick up schedule must be approved by the Director of <br />Public Works. <br /> <br />(f) A seating layout for the sanctuary must be approved by the Building Official. <br /> <br />(g) The subject property shall be maintained clear and free of trash and debris and <br />the grass kept cut. <br /> <br />(h) The applicant shall provide a parking plan that is to be approved prior to the <br />church operations begin by the City Engineer and the Director of Planning. <br /> <br />(i) The applicant shall provide a time schedule of when work is to begin and <br />milestones until completion. <br /> <br />(j) The applicant shall provide a listing of activities the church proposes to operate <br />from the facility <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />Motion by Ms. Randall, and seconded by Mr. Moody, to adopt the following <br />ordinance approved on first reading at the November 10, 2009 meeting, and was <br />adopted by the following vote: <br />
