November 24. 2009 (e) Will be In accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That a use permit is hereby granted pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (2006) to operate church at 812 Washington Street, Portsmouth, Virginia, and being more particularly described as: UP-09-13 Beginning at a the point of intersection between the western line of Washington Street and the northern line of South Street, thence proceeding 147 feet more or less along the northern line of South Street to a point, thence turning northwardly and proceeding 113 feet more or less to a point, thence proceeding westwardly 33 feet more or less to a point, thence proceeding northwardly 116 feet more or less to a point in the southern line of Columbia Street, thence proceeding eastwardly along the southern line of Columbia Street 181 feet more or less to a point being the point of intersection between the western line of Washington Street and the southern line of Columbia Street, thence southwardly along the western line of Washington Street 229 feet more or less to the point of beginning. 3. That the use permit is approved subject to the following conditions which shall be observed by the applicant and any successor in interest: (a) Prior to site plan approval, a subdivision plat must be recorded which creates a single parcel of land and vacates all internal lot lines. (b) Approval of final development, including a landscaping plan, must be obtained from Downtown Design Committee. (c) Hours of operation are approved for 24 hours seven, days a week. (d) Site Plan approval must be obtained. (e) Private Trash Hauler and pick up schedule must be approved by the Director of Public Works. (f) A seating layout for the sanctuary must be approved by the Building Official. (g) The subject property shall be maintained clear and free of trash and debris and the grass kept cut. (h) The applicant shall provide a parking plan that is to be approved prior to the church operations begin by the City Engineer and the Director of Planning. (i) The applicant shall provide a time schedule of when work is to begin and milestones until completion. (j) The applicant shall provide a listing of activities the church proposes to operate from the facility 4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council."
