48 <br /> <br />November 21, 1989 <br /> <br /> WHEREAS, the applicant and the Planning Director have done <br />all things required to be done in connection with said <br />application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the <br />granting of a revised use permit. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia; <br /> <br /> 1. That the use for which the use permit is sought: <br /> <br /> (a) Will not affeCt the health and safety~of persons <br />residing or working in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public ~se or~ <br />injurious to the property and improvements .in the neighbOrhood; <br />and <br /> <br /> (c) will be in accordance with the purposes of the Zoning <br />Chapter of the City Code. <br /> <br /> The Portsmouth ~rea Resource C~ali~ion, Incorp0rat~ed is' <br />hereby granted a use permit pursuant to Section 40-78 (b) of the <br />Code of the City of Portsmouth, Virginia to operate a temporary <br />residence facility at the Dale Homes Recreation Center at 1900 <br />Columbus Avenue, such site being more particularly described as <br />follows: <br /> <br />UP-89-20 <br /> <br /> Beginning at the southwest intersection of Dale Drive and <br />Columbus Avenue; thence south along the west right-of-way line <br />of Columbus Avenue 283'; thence west 20'; thence north 123o64'; <br />thence west 113.26'; thence north 159.36'~ thence east 113.26' <br />to the west right-of-way of Columbus Avenue. <br /> <br /> 3. The following conditions are prescribed for this use <br />permit: <br /> <br /> (a) 'APp~6~al ~f the planned expansions of the physical <br />plant and occupancy-shall be secured by the applicant from the <br />Portsmouth Redevelopment and Housing Authority; <br /> <br /> (b) The proposed expansion of t~e physical plant and of <br />the indoor and outdoor recreation areas must be built to conform <br />with thespians ~submitted with the'use permit application; <br /> <br /> (c) Six parking places must be provided to accommodate <br />the staff and residents of the facility; <br /> <br /> (d) All Outdoor play areas Shall be conducted within a <br />fenced area and between the hours of dawn and dusk. <br /> <br /> (e) The applicant shall comply with all applicable codes, <br />ordinances, policies and regulations of Federal, State, and <br />local governments and shall obtain all necessary licenses and <br />permits." <br /> <br />89-445 "AN ORDINANCE TO APPROPRIATE $60,000.
