<br /> On motion of Mr. Gray and~secohded by Mr. Simpson, the
<br />following items approved on first reading at the Public Bearing
<br />Meeting of December 1i, 1989, were adopted on final reading,
<br />and by, the following vote:

<br />"A RESOLUTION GRANTING APPROVAL OF A GROUP ~OUSING
<br />PROJECT PURSUANT TO SECTION 40-55 OF THE CODE OF THE
<br />CITY OF PORTSMOUTH,~VIRGINIA, 1988, CONSISTING OF
<br />THIRTY-ONE APARTMENTS AT 527 HIGH STREET.
<br />
<br /> WHEREAS, Vernon Wimbrough, has made application pursuant
<br />to [40-55 of the Code of the City of Portsmouth, Virginia,
<br />1988, as amended, for the granting and approval of a group
<br />housing project consisting of thirty-one apartments to be
<br />developed~ a~ 527 High. Street, such premises further described
<br />as Tax Map 13, Parcel 3, and a portion of Parcel 2, and such
<br />group housing project having been designated at GHP-89r8 and
<br />consisting of four (4) two (2) bedroom units and twenty-se~en
<br />(27) one bedroom units in the existing structure at 527 High
<br />Street, all units ~ithin the existing structure on the
<br />property7 and~ · ~, · ~ ~ ~

<br /> WHEREAS, the application has been determined by the
<br />Planning C0mmlss~on to have met the requirements of:[40-55 of
<br />the Cod~of?.%~¢i<ty~of Portsmouth,~irginia, 19~88,~ as amended,
<br />and the Planning Commission has reviewed such application and
<br />site plans submitted therewith and has recommended a
<br />conditional approval of said application; and
<br />
<br /> WHEREAS, the developer has been informed that the approval
<br />of a group housing project pursuant to ~40-55 grants only an
<br />exemption from certain requirements for residences as stated in
<br />said section, and does not constitute a waiver of any other
<br />requirement embodied in the Subdivision Ordinance, Zoning
<br />Ordinance, Code of the City of Portsmouth, or any other
<br />applicable local, state or federal law or regulation; and
