December 12, 1989 <br /> <br /> Motion of Mr. Gray and seconded by Mr. Barnes, that the <br />resolution be adopted to provide vegetation screening on three <br />sides of the grassy area; adequate screening be determined <br />by the Planning Commission; the applicant be allowed 45 days to <br />comply with the condition; a~d~ the~us~ permit issued to Mr. <br />wilcox is non-transferable, was defeBted by the following vote: <br /> <br /> Ayes: Barnes, Gray, Hawks <br /> Nays: Corprew, Simpson, Webb <br /> <br /> Motion- of'~Mr.'.Corprew and ~econded'by Mr. Simpson, that <br />the r~solatioh~'be~amended to allow~t~e applicant to p~o~ide <br />screening along Rapidan Street only, and was defeated by the <br />following vote: <br /> <br /> Ayes: Corprew, Simpson <br /> Na~s:.B~'r~es;~ Gray, Hawks, Webb <br /> <br /> M~ti~n-'of~Mr~'-C~rew and s~conded by Mr. SimpsOn, to <br />ask Mr. Wilcox to answer questions concerning the screening and <br />his willingness to comply with the conditions. <br /> <br /> Motion of Mr. Gr~y and seconded b~ Mr. Simpson~ that the <br />following ~es~lution be adopted; with the condition and the <br />recommendRtions Of the Plannin'g C~m~is,sion; and the applicant <br />allowed 45 days to comply with the conditions set forth; and <br />was adopted by the following vote: <br /> <br /> Mot'ion'to amend by Mr. Hawks and seconded by Mr. Gray, <br />that the resolution be issued to James A. Wilcox at 3709 <br />Victory Boulevard and be non transferable. <br /> <br /> "A RESOLUTION GRANTING A USE PERMIT TO JAMES~ WILCOX FOR <br /> THE OPERATION OF A FLEA MARKET AT 3709 VICTORY BOULEVARD. <br /> <br />W~EREAS;-~James Wilcox has made application pursuant-to . <br />Section 40-71(b) of the Code of the City of Portsmouth, <br />Virgi~ia,~9~8~for the granting~f a ~se' permit-as , ~ <br />hereinaf%~r-d~cribed; and · <br /> <br /> W~EREAS, the applicant and the Planning Director have done <br />all thi~s~r'eq~ired ~to be d~ne in. connect-ion with said <br />application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the <br />denial of said use"permit. <br /> <br /> NOW; THEREFORE, BE IT RESOLVEU by the Council of-the City <br />of Portsmouth, Virginia: ~ ~ <br /> <br /> 1. That the use for which the use permit <br />hereinaf{er-deScribed is sought: ' <br /> <br /> (a) Will not adversely affect the health and safety of <br />persons r~siding~or:working in the nsighborhood of the proposed <br />use; <br /> <br /> (b) ~ will n~t be detrimental ~o the public use or <br />injurious to the proper~y or improvements of the neighborhood~ <br />and <br /> <br /> (c) Will be in accordance with the purposes of the Zoning <br />Chapter of the City Code. <br /> <br /> <br />
