November 4. 2009 At a Called Meeting of the City Council on Wednesday, November 4, 2009, there were present: Mayor James W. Holley III, *Vice Mayor William E. Moody, Jr., Charles B. Whitehurst Sr., Marlene W. Randall, Douglas L. Smith. 09 - 548 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the 6th Floor Conference Room, 801 Crawford Street, 6:00 p.m., Wednesday, November 4, 2009 for the purpose of a Closed Meeting. By order of the Mayor." '" The following statement was read by Ms. Randall: Mr. Mayor: As you know, we received notice earlier today from Ms. Psi mas that she will be unable to attend tonight's closed meeting in person because of a temporary illness. Because it would be in the public interest to have her participate in the meeting, I move pursuant to Virginia Code S2.2-3708.1 that Ms. Psi mas be permitted to participate by telephone from her home in our closed meeting. For the record, and for the benefit of the public, I do wish to reaffirm that no final official action can be taken in this closed meeting, or in any other closed meeting. Action on any matter of official business may be taken only by recorded vote in open session. Motion by Ms. Randall, and seconded by Mr. Whitehurst, pursuant to the Virginia Code Section 2.2-3708 that Ms. Psi mas be permitted to participate by telephone from her home in our closed meeting, and was adopted by the following vote: Ayes: Randall, Smith, Whitehurst, Holley Nays: None 09 - 549 - Motion by Mr. Smith, and seconded by Mr. Whitehurst, to go into Closed Meeting pursuant to provisions of Section 2.2-3711 of the Code of Virginia, to discuss the performance of a specific public officer or officers, as per subsection 1. The subject matter of the meeting includes discussion of the performance of an appointed official or officials. The purpose of the meeting is to permit confidential discussion of performance matters. The motion was adopted by the following vote: Ayes: Moody, Psimas, Randall, Smith, Whitehurst, Holley Nays: None Motion by Ms. Randall, and seconded by Mr. Whitehurst, pursuant to Section 2.2-3712(0) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and 2. Only such public business matters as were identified in the motion, by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council.
