<br />October 27. 2009 <br /> <br />(f) As the current Applicant is a not-for-profit 501 (c) 3 tax-exempt Human Services <br />Organization, it is responsible to perform its fiduciary duty with the best interests of its <br />Charter, Mission and Objective. Under conditions numbered (b) through (d) above, the <br />City of Portsmouth, any Department, Agency or affiliated entity thereof, shall not use <br />their approval rights, granted above in the form of approval of a Business Plan and lor <br />Operations Plan, to instruct, influence, require, or otherwise mandate the Applicant <br />provide, expand, reduce or eliminate any service, participate in any endeavor, <br />Committee, membership, or endorsement, nor require the use of any personnel or <br />service provider outside the scope of the Applicant's submitted Business Plan and <br />Operation Plan. In all instances, the Applicant shall be permitted to operate freely within <br />its Approved Business Plan and Approved Operation Plan in compliance with all <br />applicable laws and regulations at a Federal, State and Local level. <br /> <br />(g) Approval of the final development must be obtained from the Downtown Design <br />Commission (DDC). <br /> <br />(h) Hours of operation shall be limited to 6:00 a.m. to 8:00 p.m., seven days a week. <br /> <br />(i) Site Plan approval must be obtained. <br /> <br />(j) Bike racks for at least 25 bicycles shall be provided. <br /> <br />(k) A cul-de-sac or 'T' type turnaround space must be provided at the southern end <br />of Williamsburg Avenue. <br /> <br />(I) A landscaping plan must be approved by the Director of Planning. <br /> <br />(m) An ingress/egress and utility easement along the entire east-west run of the <br />portion of Columbia Street shall be recorded and maintained. <br /> <br />(n) A utility/drainage easement 15 feet in width shall be recorded along the western <br />property line. <br /> <br />(0) Private trash hauler and pick up schedule must be approved by the Director of <br />Public Works <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />09-509 (c): <br /> <br />"RESOLUTION APPROVING A CONSERVATION PLAN FOR THE TRUXTUN <br />CONSERVATION PROJECT. <br /> <br />WHEREAS, there has been presented to the City Council for consideration and <br />approval, a copy of a Conservation Plan for the Truxtun Conservation Project ("the <br />Plan"), which Plan addresses the deterioration and early stages of blight within the <br />Conservation Project Area ("the Project Area"), as defined in the Plan; and <br /> <br />WHEREAS, the Project Area, which has been determined to be in a state of <br />deterioration or early blight, is to be conserved and redeveloped in accordance with the <br />Plan; and <br /> <br />WHEREAS, the Plan provides an outline for the conservation and redevelopment <br />of the Project Area and is sufficiently complete to satisfy the required elements set out <br />in Sections 36-51 and 36-51.1 of the Code of Virginia, 1950, as amended; and <br /> <br />WHEREAS, the Plan provides for relocation payments pursuant to applicable <br />law; and <br />
