September 22. 2009 At a Regular Meeting of the City Council on Tuesday, September 22, 2009, there were present: Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psi mas, Douglas L. Smith, City Manager Kenneth L. Chandler, City Attorney G. Timothy Oksman. Reverend Nathan Brown, opened the meeting with prayer, which was followed the Pledge of Allegiance to the Flag. Mayor Holley called the meeting to order and welcomed all in attendance. Motion by Mr. Smith, and seconded by Ms. Randall, to approve the minutes of a Called Meeting of September 8, 2009, of a Regular Meeting of September 8, 2009, and of a Called Meeting of September 15, 2009 and was adopted by the following vote: Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley Nays: None 09 - 487 - Presentations: . Presentation of a 35 Star Flag to the City of Portsmouth by Commander H. O. Brown and the Disabled American Veterans #41. . Proclamation presented to Susan Cocke for the "20th Annual Great Chesapeake Bay Schooner Race Days." . Proclamation presented to Sandra Becker for "Domestic Violence Awareness Month." . Proclamation presented to the Museum of Fine Arts Commission for "National Arts and Humanities Month." . City Manager Chandler introduced Mr. J. Brannon Godfrey as Deputy City Manager. 09 - 488 - Motion to appoint Crystal Larsen as Deputy City Clerk. Motion by Mr. Whitehurst, and seconded by Ms. Psimas, to appoint Crystal Larsen as Deputy City Clerk, and was adopted by the following vote: Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley Nays: None - Public Hearing - 09-489 Public hearing on the proposed Enterprise Zone Application to the Virginia Department of Housing and Community Development. 1. Mark Geduldig-Yatrofsky, 2713 Sterling Point Drive, spoke in opposition to this item. - Unfinished Business - 09 - 459 - Use permit: 09-459 (a): (a) Ordinance granting the request of the City of Portsmouth to amend Chapter 40 (Zoning Ordinance) of the City Code to address new design standards and processes for the Downtown District.
