September 22. 2009 At a Called Meeting of the City Council on Tuesday, September 22, 2009 there were present: Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. Randall, *Stephen E. Heretick, Elizabeth M. Psimas, Douglas L. Smith, City Manager Kenneth L. Chandler, City Attorney G. Timothy Oksman. 09 - 484 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the 6th Floor Conference Room, 801 Crawford Street, 5:00 p.m., Tuesday, September 22, 2009 for the purpose of a Public Work Session. In addition, you may consider a motion to go into a Closed Meeting. By order of the Mayor." 09 - 485 - The following items were discussed in Public Work Session: 1. Simonsdale - $18 M Qualified School Construction Bond (QSCB) Allocation from Governor Kaine - David Rose, Senior Vice President, Davenport and Company. 2. Former Navy YMCA Building at 517 King Street - Paul Holt, Deputy City Manager 3. Presentation of Legislative Drafts - Sherri Neil, Legislative and Management Analyst 4. City Council Liaison Reports Councilman Douglas Smith - . Provided an update on the Hampton Roads Transportation Policy Organization (HRTPO). 09 - 486 - Motion by Mr. Moody, and seconded by Ms. Psi mas, to go into Closed Meeting pursuant to provisions of Section 2.2-3711 (A)(1) of the Code of Virginia, to discuss performance of specific public officials. The subjects of the meeting are the City Sheriff and the member of the Municipal Finance Commission. The purpose of the meeting is to permit confidential discussion of this subject. The motion was adopted by the following vote: Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley Nays: None Motion by Mr. Whitehurst, and seconded by Mr. Smith, pursuant to Section 2.2- 3712(D) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and 2. Only such public business matters as were identified in the motion, by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council. The motion was adopted by the following vote:
