<br />September 8. 2009 <br /> <br />(k) All taxes and fees in connection with the proposed use shall be paid when due. <br /> <br />(I) The owners andlor operators of the establishment shall not violate any laws of <br />the Commonwealth or ordinances of the City related to peace and good order, not suffer <br />repeated or chronic violations by any of its patrons or customers. If the Chief of Police, <br />in his discretion, determines that there are significant violations of this type to comprise <br />a significant law enforcement problem, he shall so notify the applicant in writing and <br />shall provide a copy of such notice to the Director of Planning. If, within six months of <br />the date of such letter, the Director of Planning determines that the offenses against <br />peace and good order are continuing, then he may initiate proceedings for the <br />revocation of this permit. Provided, however, that if at any time problems exist of such a <br />severity that the Chief of Police determines that there is a significant risk to public safety <br />or peace and good order of such proportions as to create a risk of blight, revocation <br />proceedings may be initiated by the Director of Planning regardless of the six month <br />requirement. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Heretick, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />09 - 394 - Adoption of a resolution authorizing the City Engineer to exceed by 25% or <br />more the Ebony Heights Neighborhood Improvements contract in order to expand <br />significantly the scope of the original project. Vision Principle: Thriving Neighborhoods <br />and a Sense of Community. <br /> <br />Background: <br />. Ebony Heights is one of the four priority neighborhoods on the original list to <br />receive neighborhood drainage and street improvements. <br />. This phase of the improvement project for Ebony Heights will provide a drainage <br />outfall for the neighborhood. <br /> <br />Discussion: <br />. The low bid was less than half the Engineer's estimate. Fourteen out of 17 bids <br />were below the Engineer's estimate. The project costs are based on unit prices and <br />could be expanded at the bid rate. <br />. At the civic league meeting where the project was presented to the <br />neighborhood, the majority expressed a desire to have the old rail road right of way <br />piped instead of a ditch as designed. Piping this ditch was to be a part of future phases. <br />. The estimate to perform this work based on unit prices provided by the low <br />bidder is still within limits of the project budget. Additionally, the combined total is still <br />within the original Engineer's estimate and budget. <br /> <br />Financial Impact : <br />. Monies were budgeted for this project in the current capital improvements plan. <br />The current contract amount is $756,733.58. Sufficient funds are available in the <br />Capital Budget to cover the amount of this change order which is approximately <br />$350,000. Most current available project budget is $1,764,847. <br /> <br />Recommended Action: <br />. Request approval to exceed the 25% limit of allowable change orders to the <br />Ebony Heights Neighborhood Improvements contract due to favorable bids and to <br />capitalize on the opportunity to significantly increase the original size of the project. <br />Vision Principle: Thriving Neighborhoods and a Sense of Community. <br /> <br />1.
