144 March 27, 1990 1. That the use for which the use permit hereinafter-described is sought: (a) will not adversely affect the health and safety of persons residing~'or working in the neighborhood of the proposed use; ~(b) will not be detrimental tb the public use or injurious to the property or improvements of the neighborhood; and (c) will be in accordance with the purposes of the Zoning Chapte~ of the City Code. 2. J. Michael Keating and Michele Bordelon are hereby granted a use permit pursuant to [40-102.2 (B) (1) of the Code of the City of PortsmoUth, Virginia,~ 1988, for the operation of a bed and~br~akfast inn on property loCated at 415 North Street and being more particularly described as: ~ ~ UP.90-'3 BEGINNING on the south right-of-way line of North Street at a point 125' ~ west from its intersection with the west right-of-way of Court Street; thence south along a side property line 115' + to a,point; thence west 57' ~; thence north i15' +_--to the south right-of-way line of North Street; thence east along said right'of~way 57' ~ tO the point of beginning. 3. This use permit is approved subject to the following conditions: (a) The bed and breakfast inn must be operated in accordance with the "Proposal for Olde Towne Bed and Breakfast" identified as Exhibit 5 of the use permit application. (b) The applicant sh~li'c~mp~'with all applicable codes, ordinances~ policies, and regulations of federal, !state and local governments, including the "Special Regulations" of [40-102.2 (c) of the Zoning Ordinance, and shall obtain all necessary license~ and permits. (c) The use permit is issued to J. "In January, 1988, City Council approved award of a contract to Miller-Stephenson and Associates to complete final plans for Phase I of the Brighton/South Portsmouth drainage and street improvement project. At this time, construction plans are complete and the City Attorney's office is assisting the Engineering staff in the acquisition of approximately 2.45 acres of properties and easements necessary for the drainage outfall installation; We anticipate the cost of plat preparat~gn, appraisal fees, attorney fees, property and easement acquisition to cost approximately $88,000.
