That the use for which the use permit <br />hereinafter-described is sought: <br /> <br /> (a) will not adversely affect the health and safety <br />of persons residing~'or working in the neighborhood of the <br />proposed use; <br /> <br /> ~(b) will not be detrimental tb the public use or <br />injurious to the property or improvements of the neighborhood; <br />and <br /> <br /> (c) will be in accordance with the purposes of the <br />Zoning Chapte~ of the City Code. <br /> <br /> 2. J. Michael Keating and Michele Bordelon are hereby <br />granted a use permit pursuant to [40-102.2 (B) (1) of the Code <br />of the City of PortsmoUth, Virginia,~ 1988, for the operation of <br />a bed and~br~akfast inn on property loCated at 415 North Street <br />and being more particularly described as: <br /> <br /> ~ ~ UP.90-'3 <br /> <br /> BEGINNING on the south right-of-way line of North <br /> Street at a point 125' ~ west from its intersection <br /> with the west right-of-way of Court Street; thence <br /> south along a side property line 115' + to a,point; <br /> thence west 57' ~; thence north i15' +_--to the south <br /> right-of-way line of North Street; thence east along <br /> said right'of~way 57' ~ tO the point of beginning. <br /> <br /> 3. This use permit is approved subject to the following <br />conditions: <br /> <br /> (a) The bed and breakfast inn must be operated in <br />accordance with the "Proposal for Olde Towne Bed and Breakfast" <br />identified as Exhibit 5 of the use permit application. <br /> <br /> (b) The applicant sh~li'c~mp~'with all applicable <br />codes, ordinances~ policies, and regulations of federal, !state <br />and local governments, including the "Special Regulations" of <br />[40-102.2 (c) of the Zoning Ordinance, and shall obtain all <br />necessary license~ and permits. <br /> <br /> (c) The use permit is issued to J. Michael Keating <br />and Michele' ~ordel0n and is not t~ansferable to any other <br />individual, entity,_or organization~ <br /> <br />Ayes: 'Barnes, Gray, Hawks, <br />Nays: Corprew <br /> <br />Lucas, Simpson, Webb <br /> <br /> - REPORTS FROM THE CITY MANAGER - <br /> <br />90-105 Letter from the City Manager recommending~adoption of <br />an ordinance to appropriate $88,000 from the Capital Improvement <br />Fund for property and easement acquisition, etc. for Phase I of <br />Brighton/South Portsmouth. <br /> <br /> "In January, 1988, City Council approved award of a <br />contract to Miller-Stephenson and Associates to complete final <br />plans for Phase I of the Brighton/South Portsmouth drainage and <br />street improvement project. <br /> <br /> At this time, construction plans are complete and the City <br />Attorney's office is assisting the Engineering staff in the <br />acquisition of approximately 2.45 acres of properties and <br />easements necessary for the drainage outfall installation; We <br />anticipate the cost of plat preparat~gn, appraisal fees, <br />attorney fees, property and easement acquisition to cost <br />approximately $88,000. <br /> <br /> <br />
