<br />AUQust 25. 2009 <br /> <br />At a Regular Meeting of the City Council on Tuesday, August 25, 2009, there <br />were present: <br /> <br />Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, <br />Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psi mas, Douglas L. Smith, <br />City Manager Kenneth L. Chandler, City Attorney G. Timothy Oksman. <br /> <br />Councilman Charles B. Whitehurst, Sr., opened the meeting with prayer, which <br />was followed the Pledge of Allegiance to the Flag by Boy Scout Troop 246. <br /> <br />Mayor Holley called the meeting to order and welcomed all in attendance. <br /> <br />Motion by Mr. Moody, and seconded by Mr. Heretick, to approve the minutes of a <br />Called Meeting of August 10, 2009, of a Called Meeting of August 11, 2009, and of a <br />Regular Meeting of August 11, 2009, and was adopted by the following vote: <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />- Public Hearing - <br /> <br />09-439 <br /> <br />Public hearing to receive citizen input concerning the proposed <br />authorization of a Revised Sale and Development Agreement for the <br />purchase of certain property commonly known as 415 PortCentre <br />Parkway, Portsmouth, Virginia; the renovation of the existing building on <br />said property; and the construction of additional necessary facilities for the <br />total relocation of the Portsmouth courts, being Circuit Court, General <br />District Court, and Juvenile and Domestic Relations District Court, plus <br />the Clerk's Offices of said courts and certain support offices. The amount <br />of the proposed agreement shall not exceed $77,798,292. <br /> <br />1. Coleman Young, 602 North Street, spoke in opposition to this item. <br /> <br />2. Mark Geduldig-Yatrofsky, 2713 Sterling Point Drive, spoke in opposition to this item. <br /> <br />3. Steve Carroll, 3112 Riveredge Drive, asked that City Council defer voting on this item <br />so that citizens could have more time to review agreement. <br /> <br />4. Robert Forbes, 2813 Pinewell Street, wanted to know if the City Jail was part of the <br />proposal. <br /> <br />5. William Connolly, 475 Water Street, wanted to know what would happen once the old <br />court building was empty and was the demolition money included in the amount of <br />the proposed agreement. <br /> <br />09 - 440 - Public hearing on a use permit application: <br /> <br />UP-09-11 <br /> <br />DOWNTOWN - David L. Griffin, Sr. requests a use permit to operate an <br />entertainment establishment at 509 and 511 High Street. The <br />Comprehensive Plan Future Land Use Map recommends Commercial <br />Development in the area. Vision Principle: A Robust and Prospering <br />Economy. <br /> <br />1 Fred Sanborn, 220 North Street, asked that there be input from law enforcement. <br /> <br />Motion by Mr. Moody, and seconded by Ms. Psimas, to concur with the <br />recommendation of the Planning Commission that UP-09-11 be approved on first <br />reading, and was adopted by the following vote: <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br />
