AUQust 24. 2009 At a Called Meeting of the City Council on Monday, August 24, 2009, there were present: Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psi mas, Douglas L. Smith, City Manager Kenneth L. Chandler, City Attorney G. Timothy Oksman. 09 - 430 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the 6th Floor Conference Room, 801 Crawford Street, 6:00 p.m., Monday, August 24, 2009 for the purpose of a Public Work Session. In addition, you may consider a motion to go into a Closed Meeting. By order of the Mayor." 09 - 431 - The following items were discussed in Public Work Session: 1. American Recovery and Reinvestment Act (ARRA) of 2009 City of Portsmouth Stimulus Funding Sources and Projects - Steven Lynch, Director of Economic Recovery 2. Downtown Design Regulations (DDC); Downtown Master Plan and Waterfront Strategy - Paul Holt, Deputy City Manager 3. Re-Energy Proposal Update - Larry Richardson, Principal, Re-Energy '" City Council directed City Attorney Oksman, as the Southeastern Public Service Authority (SPSA) member, to "post" the Re-Energy Proposal at the August 26, 2009 SPSA meeting. 09 - 432 - Motion by Mr. Heretick, and seconded by Ms. Psi mas, to go into Closed Meeting pursuant to provisions of Section 2.2-3711 (A), of the Code of Virginia, to consult with legal counsel about specific legal matters requiring legal advice, as authorized by paragraph 7. The subject matter is the Southeastern Public Service Authority, its rates, and various privatization offers it is considering. The purpose of shall be to permit confidential discussion of negotiating position and strategy. The motion was adopted by the following vote: Ayes: Heretick, Psi mas, Randall, Smith, Whitehurst, Holley Nays: Moody Motion by Mr. Heretick, and seconded by Ms. Psi mas, pursuant to Section 2.2- 3712(D) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and 2. Only such public business matters as were identified in the motion, by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council.
