<br />AUQust 24. 2009 <br /> <br />At a Called Meeting of the City Council on Monday, August 24, 2009, there were <br />present: <br /> <br />Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst <br />Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psi mas, Douglas L. Smith, <br />City Manager Kenneth L. Chandler, City Attorney G. Timothy Oksman. <br /> <br />09 - 430 - The following call for the meeting was read: <br /> <br />"Please attend a Called Meeting of the City Council to be held in the 6th Floor <br />Conference Room, 801 Crawford Street, 6:00 p.m., Monday, August 24, 2009 for the <br />purpose of a Public Work Session. <br /> <br />In addition, you may consider a motion to go into a Closed Meeting. <br /> <br />By order of the Mayor." <br /> <br />09 - 431 - The following items were discussed in Public Work Session: <br /> <br />1. American Recovery and Reinvestment Act (ARRA) of 2009 City of Portsmouth <br />Stimulus Funding Sources and Projects - Steven Lynch, Director of Economic <br />Recovery <br /> <br />2. Downtown Design Regulations (DDC); Downtown Master Plan and Waterfront <br />Strategy - Paul Holt, Deputy City Manager <br /> <br />3. Re-Energy Proposal Update - Larry Richardson, Principal, Re-Energy <br /> <br />'" City Council directed City Attorney Oksman, as the Southeastern Public Service <br />Authority (SPSA) member, to "post" the Re-Energy Proposal at the August 26, <br />2009 SPSA meeting. <br /> <br />09 - 432 - Motion by Mr. Heretick, and seconded by Ms. Psi mas, to go into Closed <br />Meeting pursuant to provisions of Section 2.2-3711 (A), of the Code of Virginia, to <br />consult with legal counsel about specific legal matters requiring legal advice, as <br />authorized by paragraph 7. <br /> <br />The subject matter is the Southeastern Public Service Authority, its rates, and <br />various privatization offers it is considering. <br /> <br />The purpose of shall be to permit confidential discussion of negotiating position <br />and strategy. <br /> <br />The motion was adopted by the following vote: <br /> <br />Ayes: Heretick, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: Moody <br /> <br />Motion by Mr. Heretick, and seconded by Ms. Psi mas, pursuant to Section 2.2- <br />3712(D) of the Code of Virginia, certifying that to the best of the Council Members' <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br /> <br />1. Only public business matters lawfully exempted from open meeting <br />requirements by the Virginia Freedom of Information Act, and <br /> <br />2. Only such public business matters as were identified in the motion, by which <br />the Closed Meeting was convened, were heard, discussed or considered in <br />the meeting by the City Council. <br />
