162 <br /> <br />April 10, 1990 <br /> <br /> On motion of Mr. Gray and seconded by Mr. Barnes, the <br />following ordinance was approved on first reading, and by <br />unanimous vote: <br /> <br /> "AN ORDINANCE TO APPROPRIATE $50,000 FROM THE CAPITAL <br /> IMPROVEMENT FUND TO COMPLETE THE NECESSARY CAPITAL <br /> IMPROVEMENTS TO THE POKEY SMOKEY RAILROAD." <br /> <br /> 90-134 - Letter from the Interim City Manager recommending <br />adoption~of an ordinanCe to amend the Code of the City-of <br />PortsmOuth, virginia, 1988, as~amended, by amending:section. <br />35,416 and Ordaining~section 35'417 thereof) pertaining to <br />taxation. ~ ' : ~ <br /> <br /> "The Commissioner of the Revenue wishes to add to his <br />arsenal weapons to combat delinquency in reporting and <br />remitting restaurant food tax. To accomplish that goal, the <br />Commissioner requests that Our ordinance be amended to make the <br />penalty for violation more stringent and to require a bond or a <br />letter of credit for new restaurants and for existing <br />restaurants with a record of delinquency, to ensure reporting <br />and payment <br /> <br />~ The City Attorney has reviewed this request and has <br />prepared an ordinance which will strengthen our enforcement and <br />collection activities. <br /> <br /> I; therefore, concur and recommend the adoption of this <br />ordinance." <br /> <br /> Motion of Mr. Hawks and seconded by Mrs. Lucas to defer <br />the item until the regular meeting of April 24th and requested <br />that information from other locals concerning taxation be <br />provided and was adopted by unanimous vote. <br /> <br /> 90-135 - Letter from the Interim~City Manager recommending <br />adoption of an ordinance to amend the Code of the City of <br />Portsmouth, Virginia, 1988, as amended, by amending section <br />20-7 to chapter 20, pertaining to licenses. <br /> <br /> "The Commissioner of the Revenue has requested that a <br />change be made to our City Code as it pertains to the penalty <br />for violating our business license ordinance. <br /> <br /> This recommendation is consistent with the treatmen~ of <br />violations of this nature by other localities in this area. <br />The City Attorney advises that this proposed amendment complies <br />with the authority granted to a municipality under the Slate <br />Code. <br /> <br /> Given the above, I concur and recommend adoption of this <br />ordinance." <br /> <br /> Motion of Mr. Simpson and seconded by Mr. Barnes, the <br />following ordinance was adopted on first and final reading and <br />by the following Vote: <br /> <br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1988, AS AMENDED, BY AMENDING SECTION 20-7 TO <br />CHAPTER 20, PERTAINING TO LICENSES." <br /> <br />Ayes: Barnes, Corprew, Gray, Hawks, Lucas, Simpson, Webb <br />Nays: None ~. <br /> <br /> <br />
