162 April 10, 1990 On motion of Mr. Gray and seconded by Mr. Barnes, the following ordinance was approved on first reading, and by unanimous vote: "AN ORDINANCE TO APPROPRIATE $50,000 FROM THE CAPITAL IMPROVEMENT FUND TO COMPLETE THE NECESSARY CAPITAL IMPROVEMENTS TO THE POKEY SMOKEY RAILROAD." 90-134 - Letter from the Interim City Manager recommending adoption~of an ordinanCe to amend the Code of the City-of PortsmOuth, virginia, 1988, as~amended, by amending:section. 35,416 and Ordaining~section 35'417 thereof) pertaining to taxation. ~ ' : ~ "The Commissioner of the Revenue wishes to add to his arsenal weapons to combat delinquency in reporting and remitting restaurant food tax. To accomplish that goal, the Commissioner requests that Our ordinance be amended to make the penalty for violation more stringent and to require a bond or a letter of credit for new restaurants and for existing restaurants with a record of delinquency, to ensure reporting and payment ~ The City Attorney has reviewed this request and has prepared an ordinance which will strengthen our enforcement and collection activities. I; therefore, concur and recommend the adoption of this ordinance." Motion of Mr. Hawks and seconded by Mrs. Lucas to defer the item until the regular meeting of April 24th and requested that information from other locals concerning taxation be provided and was adopted by unanimous vote. 90-135 - Letter from the Interim~City Manager recommending adoption of an ordinance to amend the Code of the City of Portsmouth, Virginia, 1988, as amended, by amending section 20-7 to chapter 20, pertaining to licenses. "The Commissioner of the Revenue has requested that a change be made to our City Code as it pertains to the penalty for violating our business license ordinance. This recommendation is consistent with the treatmen~ of violations of this nature by other localities in this area. The City Attorney advises that this proposed amendment complies with the authority granted to a municipality under the Slate Code. Given the above, I concur and recommend adoption of this ordinance." Motion of Mr. Simpson and seconded by Mr. Barnes, the following ordinance was adopted on first and final reading and by the following Vote: "AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1988, AS AMENDED, BY AMENDING SECTION 20-7 TO CHAPTER 20, PERTAINING TO LICENSES."
