<br />AUQust 11. 2009 <br /> <br />. If the City is forced to abate the violation using City funds, a lien will be placed on <br />the property and the money will be collected in the same manner as taxes. Further, if <br />the city is forced to take such action we will prosecute the owner as provided by law. <br />We hope that this will provide a "stick and carrot" incentive approach to gain <br />compliance. <br /> <br />Financial Impact: <br />. Upon completion of the demolition or renovation, fees paid for permits, site plans, <br />or subdivision fees will be refunded up to $5,000. <br />. Property re-assessment may occur and the real estate taxes may be abated on <br />an amount equal to the costs of demolition or the fair market value of the renovation. <br />Taxes will be abated for a period of 10 years. This exemption shall be transferable with <br />the property. <br /> <br />Recommended Action: <br />. Formulate and implement standard operating procedure. <br /> <br />Motion by Mr. Whitehurst, and seconded by Ms. Psimas, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />09-422 (A): <br /> <br />"ORDINANCE TO AMEND CHAPTER 17 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (2006) BY AMENDING SECTION 17-1(d) THEREOF <br />PERTAINING TO DANGEROUS BUILDINGS AND BY ADOPTING A NEW SECTION <br />17-2 PERTAINING TO DERELICT BUILDINGS." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />Motion by Mr. Whitehurst, and seconded by Mr. Smith, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />09-422 (B): <br /> <br />"ORDINANCE TO AMEND ARTICLE III, DIVISION 5, OF CHAPTER 35 OF THE <br />CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (2006) BY ADOPTING A NEW <br />SECTION 35-191 PERTAINING TO THE EXEMPTION FROM TAXES OF <br />DEMOLISHED OR RENOVATED DERELICT BUILDINGS." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />- New Business - <br /> <br />09 - 423 - Boards and Commissions <br /> <br />Mr. Moody offered the following nominations: <br /> <br />BEHAVIORAL HEAL THCARE SERVICES ADVISORY BRD <br /> <br />Ann Massenburg to be appointed to fill a term ending June 30, 2010, replacing Lorraine <br />Edwards. <br />
