<br />At a Called Meeting of the City Council on Tuesday, August 11, 2009 there were
<br />present:
<br />
<br />Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst,
<br />Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psi mas, Douglas L. Smith,
<br />City Manager Kenneth L. Chandler, City Attorney G. Timothy Oksman.
<br />
<br />09 - 412 - The following call for the meeting was read:
<br />
<br />"Please attend a Called Meeting of the City Council to be held in the 6th Floor
<br />Conference Room, 801 Crawford Street, 5:00 p.m., Tuesday, August 11, 2009 for the
<br />purpose of a Public Work Session.
<br />
<br />In addition, you may consider a motion to go into a Closed Meeting.
<br />
<br />By order of the Mayor."
<br />
<br />09 - 414 - Motion by Mr. Moody, and seconded by Mr. Whitehurst, to go into Closed
<br />Meeting pursuant to provisions of Section 2.2-3711 (A) of the Code of Virginia, to
<br />discuss:
<br />
<br />1. appointments to boards and commissions, as per subsection 1
<br />
<br />2. matter involving the performance of individual employees or officials of the
<br />City, as per subsection 1
<br />
<br />3. the purchase of real estate for a public purpose, as per subsection 3, and also
<br />
<br />4. matter requiring the advice of legal counsel for the City, including discussion
<br />of pending litigation, as per subsection 7.
<br />
<br />The subjects of the meeting are (1) candidates for possible appointment, (2)
<br />personnel matters, (3) the pending lawsuit over the condition of Portsmouth courts and
<br />(4) the proposed development of new courts complex on PortCentre Parkway (formerly
<br />Court Street).
<br />
<br />The purpose of the meeting is to permit confidential discussion of these matters.
<br />
<br />The motion was adopted by the following vote:
<br />
<br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley
<br />Nays: None
<br />
<br />Motion by Mr. Moody, and seconded by Ms. Psi mas, pursuant to Section 2.2-
<br />3712(0) of the Code of Virginia, certifying that to the best of the Council Members'
<br />knowledge during the immediately preceding Closed Meeting of the City Council:
<br />
<br />1. Only public business matters lawfully exempted from open meeting
<br />requirements by the Virginia Freedom of Information Act, and
<br />
<br />2. Only such public business matters as were identified in the motion, by which
<br />the Closed Meeting was convened, were heard, discussed or considered in
<br />the meeting by the City Council.

<br />The motion was adopted by the following vote:
