<br /> WHEREAS, the City has not been able to purchase the
<br />property described herein, necessary to the pro~ect, because
<br />owners thereof and the City have not been able to agree upon
<br />the price to be paid therefor; a~-d. ~'

<br /> WHEREAS, the advancement of the work and the uss of said
<br />property will be unreasonably delayed if said property is not
<br />made available for the project as soon ~as possible.

<br /> NOW, THEREFORB,i BE' IT RESOLVED~ by the Council of the' City
<br />of Portsmouth, Virgin a.
<br />
<br /> That the City Attorney be, and he hereby is, directed to
<br />institute, eminent domain proceedings against the
<br />hereinafter-described property situate in the City of
<br />Portsmouth, Virginia, for the purpose of acquiring fee s-imple
<br />title thereto pursuant to Section 2-.06, 2.07 and 2.08 of the
<br />Charter of the City of Portsmouth, Virginia, as amended, and to
<br />deposit to the credit of the Clerk of the Circuit Court of the
<br />City of Portsmouth as provided by law the sum hereinafter
<br />specified to compensate the ownersof~h-e p~operty designat~
<br />and shown as "Plat Showing Property To Be Acquired From Bryant
<br />E. Collins, Sr. For Rights-of-way Purposes," made by
<br />engineering services, inc., Civil Engineering~Land Surveying,
<br />dated April 30, 1989, ~ copy of ~h~¢b~pi~lS attached hereto
<br />and made a part hereof.

<br /> The name of the property owner is Bryant E. Collins, Sr.
<br />
<br /> The amount to be deposited to the credit of the Clerk of
<br />the Circuit Court of the City of Portsmouth is $1200.0~."

<br />"AN RESOLUTION TO PROVIDE FOR T~E ACQUISITION OF DRAINAGE
<br />EASEMENT UPON PROPERTY OWNED BY ~ICHAEL E. WALL AND ANNA
<br />M. WALL UNDER EMINENT DOMAIN PROCEEDINGS PURSUANT TO THE
<br />CHARTER OF THE CITY OF PORTSMOUTH, SAID EASEMENT BEING
<br />NECESSARY FOR THE CONSTRUCTION OF DRAINAGE EASEME~R!TS ~
<br />IN THE HIGH STREET/SHIRLEY ROAD PROJECT.

<br /> WHEREAS, the Council of the City of Portsmouth has
<br />determined it to be in the public interest to construct a
<br />drainage easement in the High Street widening Shirley Road
<br />Project; and

<br /> WHEREAS, the City has not bee~ able ~to purchase the
<br />easement described herein, necessary to the project, because
<br />owners thereof and the'City have not been able to agree upon
<br />the price to be paid therefor; and
