Mav 26. 2009 At a Called Meeting of the City Council on Tuesday, May 26, 2009 there were present: *Mayor James W. Holley III, Charles B. Whitehurst, Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psimas, Douglas L. Smith, City Manager Kenneth L. Chandler, City Attorney G. Timothy Oksman. 09 - 281 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the 6th Floor Conference Room, 801 Crawford Street, 5:00 p.m., Tuesday, May 26, 2009 for the purpose of a Public Work Session. In addition, you may consider a motion to go into a Closed Meeting. By order of the Mayor." 09 - 282 - The following items were discussed in Public Work Session: 1. Police Chief Report - Lieutenant Scott Burke, Portsmouth Police Department, Training Unit 2. Building Officials Report - Doug Smith, Building Official 09 - 283 - Motion by Mr. Heretick, and seconded by Ms. Randall, to go into Closed Meeting pursuant to provisions of Section 2.2-3711 (A) of the Code of Virginia, to discuss personnel matters and appointments as per section 1, the disposition of publicly owned real estate, as per subsection 3, and also matters requiring the advice of legal counsel, as per subsection 7. The subjects of the meeting are: Personnel matters related to the Building Official's office - Appointments to boards and commissions The Crawford Harbor Point development site Certain easements needed by the Southeaster Public Service Authority In connection with its Refuse-Derived Fuel operations. The purpose of the meeting is to permit discussion of strategy and negotiating position on these issues. The motion was adopted by the following vote: Ayes: Heretick, Psi mas, Randall, Smith, Whitehurst, Holley Nays: None Motion by Ms. Psi mas, and seconded by Mr. Whitehurst, pursuant to Section 2.2- 3712(D) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and 2. Only such public business matters as were identified in the motion, by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council.
