346 <br /> AugUst 28, 1990 <br /> <br /> NOW, THEREFORE,i BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br /> 1. That the use for which the use permit hereinafter <br />described is sought: <br /> <br /> (a) Will not adversely affect the health and safety <br /> of persons residing and working in the neighborhood of <br /> the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or <br />injurious to the property and improvements in the <br />neighborhood; and <br /> <br /> (c) Will be in accordance with the purposes of the <br /> Zoning Chapter of the City Code. <br /> <br /> 2. That Morning Star Baptist Church is hereby granted a <br />use permit pursuant to Section 40-121(a)(vii) of the Code of the <br />City of Portsmouth, Virginia, 1988, to construct and operate a <br />church at 2111 High Street, such site being more particularly <br />described as follows: <br /> <br /> Beginning on the south right-of-way line of High <br />Street at a point 30'+ west from the west right-of-way <br />line of Constitution ~venue; thence west along the south <br />right-of-way line of High Street 150'+ to a point; thence <br />south 220.10'+ tO the north right-of-Way line of King <br />Street; thenc~ east along said right,of-way line 120'+ to <br />~ point; thence north 110.5'+ to a point; thence east--30'+ <br />to a point; thence north 110~5'+ to the south right-of-wa~ <br />line of High Street, the point ~f origin. <br /> <br /> 3. This use permit is approved subject to the following <br />conditions: <br /> <br /> (a) ~Access to the property shall only be from King <br /> Street, and the parking lot for the church shall be <br /> located on the King Street side of the property. All <br /> buildings or structures erected pursuant to this use <br />'permit shall be located on the High Street side of the <br /> property in order to screen the parking lot from view <br /> from High Street. <br /> <br /> (b) Construction of the church shall begin within <br />five (5) years of the adoption of this resolution. <br /> <br /> (c) All'improvements to the property shall be <br />constructed in accordance with plans submitted to and <br />approved by the Downtown Design Committee, or its <br />successor. Prior to commencing any construction on the <br />property, the applicant shall obtain a Certificate of <br />Compliance from the Downtown Design Committee, or its <br />successor. <br /> <br /> (d) The applicant shall comply with all applicable <br />codes, ordinances, policies and regulations of federal, <br />statet and local governments and shall obtain all <br />necessary licenses and permits." <br /> <br />Ayes: Clemons, Corprew, Epperson, King, Lucas, Webb <br />Nays: H~wks <br /> <br />OTHER ITEMS UNDER UNFINISHED BUSINESS <br /> <br /> 90-306 Motion of Mr. King and seconded by Mrs. Lucas to <br />defer the agreements with Virginia Power to the September 18, <br />1990 meeting, and was adopted by unanimous vote. <br /> <br /> <br />
