346 AugUst 28, 1990 NOW, THEREFORE,i BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit hereinafter described is sought: (a) Will not adversely affect the health and safety of persons residing and working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property and improvements in the neighborhood; and (c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. 2. That Morning Star Baptist Church is hereby granted a use permit pursuant to Section 40-121(a)(vii) of the Code of the City of Portsmouth, Virginia, 1988, to construct and operate a church at 2111 High Street, such site being more particularly described as follows: Beginning on the south right-of-way line of High Street at a point 30'+ west from the west right-of-way line of Constitution ~venue; thence west along the south right-of-way line of High Street 150'+ to a point; thence south 220.10'+ tO the north right-of-Way line of King Street; thenc~ east along said right,of-way line 120'+ to ~ point; thence north 110.5'+ to a point; thence east--30'+ to a point; thence north 110~5'+ to the south right-of-wa~ line of High Street, the point ~f origin. 3. This use permit is approved subject to the following conditions: (a) ~Access to the property shall only be from King Street, and the parking lot for the church shall be located on the King Street side of the property. All buildings or structures erected pursuant to this use 'permit shall be located on the High Street side of the property in order to screen the parking lot from view from High Street. (b) Construction of the church shall begin within five (5) years of the adoption of this resolution. (c) All'improvements to the property shall be constructed in accordance with plans submitted to and approved by the Downtown Design Committee, or its successor. Prior to commencing any construction on the property, the applicant shall obtain a Certificate of Compliance from the Downtown Design Committee, or its successor. (d) The applicant shall comply with all applicable codes, ordinances, policies and regulations of federal, statet and local governments and shall obtain all necessary licenses and permits."
