382 <br /> <br /> September 25, 1990 <br /> <br /> 90-398 - Letter from the city Manager recommending <br />adoption of resolution authorizing and creating the Auxiliary <br />Deputies Program for the Sheriff's Department of the City of <br />Portsmouth, and authorizing the Sheriff to aDpoint Auxiliary:- <br />Deputies and govern same. <br /> <br /> -,Sheriff Gary!Waters is requesting permission to initiate <br />an Auxiliary Deputy Sheriff's Program. This.will be most <br />helpful during periods of jail overcrowding and will assist him <br />in the performan6e'~f the duties'~of his Office. Adoption of <br />this resolution will acknowledge the Auxiliary Deputy-Sheriffs <br />as employees of the City for the purposes of the Worker's <br />Compensa~ion~Aq~~, ~. ~,, .... ~ ~ i~ : ~i_~, , ~ ~,:~ <br /> <br /> Sheriff Waters has agreed to provide appr0priate~tralning <br />and supervision of all Auxiliary Deputy Sheriffs. <br /> <br /> I concur with the Sheriff's recommendation and request <br /> ~proPosed resolut~on~ <br />your approval ofi~he ' "L ~ ~ f ~ <br /> <br /> Motion of Mr. Hawks and seconded by Mr. King, the <br />following resolution was adopted; and by the following vote: <br /> <br /> "A RESOLUTION AUTHORIZING AND CREATING T~E AUXILIARY <br /> DEPUTIES-PROGRAM~FORiTHE SHERI~Fi~S.-DEPARTMENT OF THE CITY <br /> OF PORTSMOUTH, AND AUTHORIZING THE SHERIFF TO APPOINT <br /> AUXILI~RY~DEPUTIES?AND.GOVERN~SAME.~ <br /> <br /> WHEREAS, it is in the City's best interest and it is <br />therefore necessary to appoint Auxiliary Sheriff!s Deputies for <br />the performance of duties which the Sheriff's Department,~s <br />mandated to perform; <br /> <br /> WHEREAS, the governing body of a City may employ a greater <br />numbe~ of~law-~nfo~cement deputies than fixed by the <br />Compensation Board, provided that the city shall pay the total. <br />compensation' and' all employer costs for. such additional <br />deputies; and <br /> <br /> WHEREAS~ AUxiliary. Sheriff~ <br />employees of the City for Worker's Compensation~ purposes only <br />provided, that the governing body of the City has adopted a <br />resolution acknowledging the Aux~iliary Sheriff's Deputies as <br />employees for the purposes of the Worker's Compensation Act, <br />pursuant to Section 65~1-4.1 of the Code of Virginla, 1950, as <br />amended; ~ , .~, .: ~ <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, virginia, that th'~ A~xiliary Deputy Program for <br />the Sheriff's Departme,nt .of.~ th~:~.i~y of ~orts~outh~ V~rg~ia, <br />be created, and the Council acknowledges the Auxiliary <br />Sheriff's Deputies as employees only for the purposes of the <br />Worker's CompensatiOn ACt in accordance w~ith Section 65.1-4.1 <br />of the Code of Virginia, 1950, as amended. ~ ~ ~., <br /> <br /> BE 'IT FURTHER RESOLVED. that ~i~he Shpri~ofhthe Ci~y(pf <br />Portsmouth is authorized to create the Auxiliary Deputies <br />Program and appoint and govern said Auxiliary Sheriff's <br />Deputies.
