These funds <br />are for a negotiated settlement with Virginia Power for <br />additional Charges on their conversion of South Street to <br />underground electric service. <br /> <br /> On June 10, 1986, Council appropriated funds for Virginia <br />Power to complete this underground conversion in accordance with <br />their May 8, 1986 cost estimate for $253,000. However, after <br />project completion, Virginia Power's final bill to the City was <br />for $538,684. The City refused to pay the overage because we <br />felt it was beyond all reasonable expectations based on their <br />estimate, i : <br /> <br /> Through the lengthy process of a lawsuit by Virginia <br />Power, a negotiated settlement of $142,842, half the excess <br />charges claimed by Virginia Power, was agreed upon. The City <br />Attorney and the Direct'Or of PubliC Works recommend approval of <br />this settlement. <br /> <br /> I, therefore, co,cur and.rec0mmend appr~0P~iation of <br />$142,842 and subsequent payment to Virginia Power." <br /> <br /> Mot~ion~of Mrs~ L:ucas and seconded by Mr. King, the <br />following ordinance was approved On first reading,.and by <br />unanimous vote: · <br /> <br /> "AN ORDINANCE TO APPROPRIATE $142,842.00 FROM THE CAPITAL <br />IMPROVEMENT FUND FOR THE CONVERSION OF SOUTH STREET TO <br />UNDERGROUND ELECTRIC SERVICE." <br /> <br /> <br />
