<br />April 7. 2009 <br /> <br />At a Special Meeting of the City Council on Tuesday, April 7, 2009, there were <br />present: <br /> <br />Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, <br />Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psi mas, Douglas L. Smith, <br />City Manager Kenneth L. Chandler, City Attorney G. Timothy Oksman. <br /> <br />Councilman Charles B. Whitehurst, Sr., opened the meeting with prayer, which <br />was followed the Pledge of Allegiance to the Flag. <br /> <br />Mayor Holley called the meeting to order and welcomed all in attendance. <br /> <br />- Public Comment - <br /> <br />09 - 1 85 <br /> <br />Presentation and opportunity for public comment pertaining to the Virginia <br />Resources Authority Resolution on the restructuring of certain outstanding <br />bonds for the Southeastern Public Service Authority of Virginia. <br /> <br />1. Ron Evans, 14 Chippewa Trail, spoke in opposition to this item. <br /> <br />2. Mark Geduldig-Yatrofsky, 2713 Sterling Point Drive, spoke in opposition to this <br />item. <br /> <br />3. Terry Danaher, 413 Dinwiddie Street, wanted to know if the Refuse Derived Fuel <br />(RDF) Facility is privatized would the City lose the option of excepting out of state <br />trash. <br /> <br />Motion by Mr. Heretick, and seconded by Ms. Psi mas, to go into Closed Meeting <br />pursuant to provisions of Section 2.2-3711 (A) of the Code of Virginia, to discuss or <br />consider: <br /> <br />. The performance of a specific public official, as per subsection 1; <br /> <br />. Investing public funds where competition or bargaining is involved, as per <br />subsection 6; and <br /> <br />The subjects of the meeting are employee performance and financial matters <br />related to the Southeastern Public Service Authority requiring the advice of the City's <br />financial advisor. <br /> <br />The purpose of the meeting is to permit confidential discussion of these subjects. <br /> <br />The motion was adopted by the following vote: <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />Motion by Mr. Moody, and seconded by Mr. Smith, pursuant to Section 2.2- <br />3712(0) of the Code of Virginia, certifying that to the best of the Council Members' <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br /> <br />3. Only public business matters lawfully exempted from open meeting <br />requirements by the Virginia Freedom of Information Act, and <br /> <br />4. Only such public business matters as were identified in the motion, by which <br />the Closed Meeting was convened, were heard, discussed or considered in <br />the meeting by the City Council. <br /> <br />The motion was adopted by the following vote: <br />
