March 23. 2009 At a Called Meeting of the City Council on Monday, March 23, 2009, there were present: Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst Sr., Marlene W. Randall, Elizabeth M. Psimas, Douglas L. Smith, City Manager Kenneth L. Chandler, City Attorney G. Timothy Oksman. 09 - 149 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the 6th Floor Conference Room, 801 Crawford Street, 6:00 p.m., Monday, March 23, 2009 for the purpose of a Public Work Session. In addition, you may consider a motion to go into a Closed Meeting. By order of the Mayor." 09 - 150 - The following items were discussed in Public Work Session: I. Data Sheet FY09 2. Regional Tax Study 3. Virginia Local Tax Rate 2008 4. Proposed Southeastern Public Service Authority Tip Rates 5. Portsmouth Public School Stimulus Funding Information 6. Port Centre Courts Update 09 - 151 - Motion by Ms. Psimas, and seconded by Mr. Whitehurst, to go into Closed Meeting pursuant to provisions of Section 2.2-3711, of the Code of Virginia, to discuss subsection 7 consultation with legal counsel and staff pertaining to litigation, and also consultation with legal counsel regarding specific legal matters requiring the provision of legal advice. The subject matter of the meeting is litigation involving the City's court facilities. The purpose of the meeting is to discuss legal strategy. Motion by Ms. Psi mas, and seconded by Mr. Whitehurst, pursuant to Section 2.2- 3712(0) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: The motion was adopted by the following vote: Ayes: Moody, Psimas, Randall, Smith, Whitehurst, Holley Nays: None 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and 2. Only such public business matters as were identified in the motion, by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council.
