March 21. 2009 At a Called Meeting of the City Council on Saturday, March 21, 2009, there were present: *Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst Sr., *Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psimas, Douglas L. Smith, City Manager Kenneth L. Chandler, City Attorney G. Timothy Oksman. 09 - 146 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the 6th Floor Conference Room, 801 Crawford Street, 8:00 a.m., Saturday, March 21, 2009 for the purpose of a Public Work Session. In addition, you may consider a motion to go into a Closed Meeting. By order of the Mayor." 09 - 147 - The following items were discussed in Public Work Session: I. Opening Remarks 2. Re-cap FY09 Budget 3. Annual Rating Agency Review 4. Revenue Forecast 2010 and 2011 5. Obligation and Expenditures 6. Other Budgetary Items 7. Adjournment 09 - 148 - Motion by Ms. Psi mas, and seconded by Mr. Whitehurst, to go into Closed Meeting pursuant to provisions of Section 2.2-3711 (A) of the Code of Virginia, to discuss consultation with legal counsel concerning pending or probable litigation, as per subsection 7 The subject matter of the meeting is the Courthouse lawsuit. The purpose of the meeting is discussion of legal strategy. Motion by Mr. Smith, and seconded by Mr. Whitehurst, pursuant to Section 2.2- 3712(0) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: The motion was adopted by the following vote: Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley Nays: None 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and 2. Only such public business matters as were identified in the motion, by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council.
