<br />March 21. 2009 <br /> <br />At a Called Meeting of the City Council on Saturday, March 21, 2009, there were <br />present: <br /> <br />*Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst <br />Sr., *Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psimas, Douglas L. Smith, <br />City Manager Kenneth L. Chandler, City Attorney G. Timothy Oksman. <br /> <br />09 - 146 - The following call for the meeting was read: <br /> <br />"Please attend a Called Meeting of the City Council to be held in the 6th Floor <br />Conference Room, 801 Crawford Street, 8:00 a.m., Saturday, March 21, 2009 for the <br />purpose of a Public Work Session. <br /> <br />In addition, you may consider a motion to go into a Closed Meeting. <br /> <br />By order of the Mayor." <br /> <br />09 - 147 - The following items were discussed in Public Work Session: <br /> <br />I. Opening Remarks <br />2. Re-cap FY09 Budget <br />3. Annual Rating Agency Review <br />4. Revenue Forecast 2010 and 2011 <br />5. Obligation and Expenditures <br />6. Other Budgetary Items <br />7. Adjournment <br /> <br />09 - 148 - Motion by Ms. Psi mas, and seconded by Mr. Whitehurst, to go into Closed <br />Meeting pursuant to provisions of Section 2.2-3711 (A) of the Code of Virginia, to <br />discuss consultation with legal counsel concerning pending or probable litigation, as <br />per subsection 7 <br /> <br />The subject matter of the meeting is the Courthouse lawsuit. <br /> <br />The purpose of the meeting is discussion of legal strategy. <br /> <br />Motion by Mr. Smith, and seconded by Mr. Whitehurst, pursuant to Section 2.2- <br />3712(0) of the Code of Virginia, certifying that to the best of the Council Members' <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br /> <br />The motion was adopted by the following vote: <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />1. Only public business matters lawfully exempted from open meeting <br />requirements by the Virginia Freedom of Information Act, and <br /> <br />2. Only such public business matters as were identified in the motion, by which <br />the Closed Meeting was convened, were heard, discussed or considered in <br />the meeting by the City Council. <br /> <br />The motion was adopted by the following vote: <br />
