January 8, 1991 <br /> <br /> WHEREAS, the Planning Commission, after notice and public <br />hearing, as required by Article IV of Chapter 11 of Title 15.1 <br />of the Code of Virginia, 1950, as amended, recommended that the <br />Comprehensive Plan, including the General Land Use Plan map, be <br />amended to show commercial development in the area alo~ng .Towne <br />Point Road between Churchland Boulevard and the Western Freeway <br />designated as "Commercial" on the map labeled Alternative "B", <br />attached hereto and.made a part hereof; and <br /> <br /> WHEREAS, the Council of the City of Portsmouth has held <br />public hearings, with notice as required by law, and considered <br />the proposed amendment, (CP-90-04), to the Comprehensive Plan. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the~Council of the City <br />of Portsmouth, ~irginia~ that the Comprehensive Plan for the <br />City of Portsmouth, Virginia, designated (CP-89-1), be and <br />hereby is, amended to show commercial development in the area <br />described above." - - <br /> <br />90-478 (d) Use Permit <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO TOWNE POINT SQUARE <br />ASSOCIATES TO-OPERATE STORAGE WAREHOUSES NEAR THE <br />INTERSECTION OF GATEWAY DRIVE AND TWIN PINES ROAD. <br /> <br /> WHEREAS, on September 26, 1989, the Council of the City of <br />Portsmouth, Virginia, granted a use permit to Towne Point <br />Square Associates to operate storage warehouses on property on <br />the south side of Gateway Drive and east of Twin Pines Road; <br />and . <br /> <br /> WHEREAS, Towne Point Square Associates has made <br />application pursuant to Section 40-71(b) of the Code of the <br />City of Portsmouth, Virginia, 1988,.as amended, to operate <br />storage warehouses on certain adjoining property more <br />particularly described, below; and <br /> <br /> WHEREAS, the Planning Commission has recommended the <br />Conditional granting of a use permit for the operation of <br />storage warehouses <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the C~t~ <br />of Portsmouth,~Virginia: <br /> <br /> 1. That the use for which the use permit is s~ught: <br /> <br />(a) Will not adversely affect the health and safety of <br />persons residing ~r working in the neighborhood of the <br />proposed use;and <br /> <br />(b) Will no~.ibe detrimental to the public use or <br />injurious to the property and iimprovements of the <br />neighborhood; and <br /> <br /> (c) Will be in accordance with the purposes of ~he Zoning <br /> Chapter of the City Code. <br /> <br /> 2. That Towne Point Square Associates is hereby granted <br />a use permit pursuant to Section 40-71(b) of the Code of the <br />City of Portsmouth, Virginia, 1988, as amended, to operate <br />storage warehouses.~on property on the south side of Gateway <br />Drive and east of Twin Pines Road, such area being more <br />particularly described as follows: <br /> <br /> <br />
