<br />At a Called Meeting of the City Council on Monday, February 9, 2009, there were
<br />present:

<br />Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst
<br />Sr., Marlene W. Randall, *Stephen E. Heretick, Elizabeth M. Psimas, Douglas L. Smith,
<br />City Manager Kenneth L. Chandler, City Attorney G. Timothy Oksman.

<br />09 - 76 - The following call for the meeting was read:
<br />
<br />"Please attend a Called Meeting of the City Council to be held in the 6th Floor
<br />Conference Room, 801 Crawford Street, 6:00 p.m., Monday, February 9, 2009 for the
<br />purpose of a Public Work Session.
<br />
<br />In addition, you may consider a motion to go into a Closed Meeting.
<br />
<br />By order of the Mayor."

<br />09 - 77 - The following items were discussed in Public Work Session:

<br />1. Downtown Design District Update - Paul D. Holt III, Deputy City Manager
<br />

<br />
<br />3. FY 09 Budget Strategy Update - Kenneth Chandler, City Manager; Betty Burrell,

<br />
<br />4. Debt Restructuring - David Rose, Senior Vice-President, Davenport & Company
<br />
<br />5. Wheelabrator Presentation - Mark Schwartz, Senior Manager of Wheelabrator; Rob
<br />Clendenin, Waste Management Community Affairs; Joel Rubin, Rubin
<br />Communications Group

<br />09 - 78 - Motion by Mr. Heretick, and seconded by Mr. Whitehurst, to go into Closed
<br />Meeting pursuant to provisions of Section 2.2-3711 (A) of the Code of Virginia, to
<br />discuss the performance of specific public officials, as per subsection 1; and legal
<br />matters requiring the advice of legal counsel, including threatened litigation, as per
<br />subsection 7.
<br />
<br />The subject of the meeting includes the performance of specific public officials of
<br />the city, the Southeastern Public Authority and other legal matters.
<br />
<br />The purpose of the meeting is to permit confidential discussion of individual
<br />officials, and also legal strategy.
<br />
<br />Motion by Mr. Heretick, and seconded by Mr. Whitehurst, pursuant to Section
<br />2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members'
<br />knowledge during the immediately preceding Closed Meeting of the City Council:

<br />The motion was adopted by the following vote:

<br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley
<br />Nays: None
<br />
<br />1. Only public business matters lawfully exempted from open meeting
<br />requirements by the Virginia Freedom of Information Act, and
<br />
<br />2. Only such public business matters as were identified in the motion, by which
<br />the Closed Meeting was convened, were heard, discussed or considered in
<br />the meeting by the City Council.
