Januarv 27.2009 At a Called Meeting of the City Council on Tuesday, January 27,2009 there were present: Mayor James W. Holley III, Charles B. Whitehurst, Sr., *Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psi mas, *Douglas L. Smith, City Manager Kenneth L. Chandler, City Attorney G. Timothy Oksman. 09 - 51 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the 6th Floor Conference Room, 801 Crawford Street, 5:00 p.m., Tuesday, January 27, 2009 for the purpose of a Public Work Session. In addition, you may consider a motion to go into a Closed Meeting. By order of the Mayor." 09 - 52 - The following items were discussed in Public Work Session: 1. FY 2009 Financial Update - Kenneth Chandler, City Manager I Betty Burrell, Chief Financial Officer 2. City Council Liaison Reports Councilman Douglas Smith - . Provided an update on the Metropolitan Planning Organization (MPO). 09 - 53 - Motion by Mr. Heretick, and seconded by Ms. Psi mas, to go into Closed Meeting pursuant to provisions of Section 2.2-3711 (A) of the Code of Virginia, to discuss appointments to boards and commissions, as per subsection 1, and legal matters requiring the advice of legal counsel, as per subsection 7. The subject matter of the meeting is Council appointments, and also probable litigation with the Southeastern Public Service Authority. The purpose of the meeting is to allow confidential discussion of appointments and legal strategy. The motion was adopted by the following vote: Ayes: Heretick, Psi mas, Randall, Smith, Whitehurst, Holley Nays: None Motion by Mr. Heretick, and seconded by Ms. Randall, pursuant to Section 2.2- 3712(0) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and 2. Only such public business matters as were identified in the motion, by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council. The motion was adopted by the following vote: Ayes: Heretick, Psi mas, Randall, Smith, Whitehurst, Holley Nays: None
