528 February 26, 1991 (c) 3Resoiution granting a Use permit~to Commerce B~nk, by Peyton Bowden for a storage warehouse on property at 47t5 Portsmouth Boulevard. "A RESOLUTION GRANTING A USE PERMIT TO COMMERCE BANK TO OPERATE A~STORAGE WAREHOUSE AT 4715.PORTSMOUT~ BOULEVARD. WHEREAS, Commerce Bank has~made~ application pursuant to Section 40-7~!b) Of the Code of the City of Portsmouth, Virginia~ 1988, as a~ended, ~to 0perate-!a storage warehouse at 4715 Portsmouth.Boulevard, said property being more particularly described below; a~da I~::~ ~ '~: ~i WHEREASy the Planning Commission has recommended the conditional granting of a use permit for the operation of a storage warehouse. NOW,'THEREFORE~ BE of Portsmouth,~Virginia: IT' RE$OLVE~'by' ~h~ Council?of the City ':~hat ~he use for which ~the use permit is sought:- (a) will not adversely affect the health and safety o~ persons residing or working in the neighborhood~i~i_~e proposed use; and (b)' Will' not be detrimental to the public use or injurious to the property and improvements of the neighborhood; and' ~ (~) Wilil be in accordance- with. the purposes of the ~ i ~ ZonLng ChaPter of the ~City Code; ~ ~ 2. That Commerce Bank is hereby granted a use permit pursuant to 4~-71(b) ~of the ~Code of the City of Portsmouth, Virginia, 1988, as amended, to operate a storage warehouse ~n property located at 4715 Portsmouth Boulevard, such area being more partic)]larly described as follows: UP-91-3 Beginning on the south right-of-way of Portsmouth 'Bou'I~v~t~a~a~p~int ~1,3~7~O'~ eas't!fr~m~ ~ts ~ters~ti~O~ with the east ~i~ht-of-way 'o~ity~Park'Ave~uer:~hence southwest 51.95'; thence easterly 2.80'; thence southwest 34.16'; thence easterly 14.77'; thence southwest 41.82'; then~ southerly 34.42'; thence easterly 28.27"; thence ~ north~56.91'; ~hence northeast 107.20, to the south right-of-way ~f~ortsmou'th~Boulevard; ~thence westerly along said right-of-way 37.56' to the point of. origin. This use permit is approved subject to the following" conditions: (a) Material stored in the warehouse shall be limited to the bank's furniture, equipment and records. (b) Ail outdoor storage on site is prohibited. (c) Any changes to the front of the facade shall be architecturally compatible with the other retail businesses in the complex. (d) Loading and unloading shall be restricted to the rear of the building.
