<br />December 9. 2008 <br /> <br />At a Called Meeting of the City Council on Tuesday, December 9, 2008, there <br />were present: <br /> <br />*Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., *Marlene W. Randall, <br />Stephen E. Heretick, Elizabeth M. Psi mas, *Douglas L. Smith, Charles B. Whitehurst, <br />Sr., City Manager Kenneth L. Chandler, City Attorney G. Timothy Oksman. <br /> <br />08 - 519 - The following call for the meeting was read: <br /> <br />"Please attend a Called Meeting of the City Council to be held in the 6th Floor <br />Conference Room, 801 Crawford Street, 5:00 p.m., Tuesday, December 9, 2008 for the <br />purpose of a Public Work Session. <br /> <br />In addition, you may consider a motion to go into a Closed Meeting. <br /> <br />By order of the Mayor." <br /> <br />08 - 520 - The following items were discussed in Public Work Session: <br /> <br />1. Comprehensive Annual Financial Report (CAFR) - Robert Bylot, Cherry, Bekaert and <br />Holland <br /> <br />2. City Council Liaison Reports <br />Councilwoman Elizabeth Psi mas - <br />. Announced that at Chesapeake Service Systems annual event the City <br />of Portsmouth received the City of the Year for assisting those with <br />disabilities. <br /> <br />08 - 521 - Motion by Mr. Moody, and seconded by Mr. Heretick, to go into Closed <br />Meeting pursuant to provisions of Section 2.2-3711 (A) of the Code of Virginia, to <br />discuss: <br /> <br />appointments by City Council, as per subsection 1; <br /> <br />legal matters requiring the advice of legal counsel, as per subsection 7; and <br /> <br />the sale of publicly owned real property, as per subsection 3. <br /> <br />The subject matter shall be appointments by City Council to boards and <br />commissions, the pending lawsuit over courthouse construction, and development for <br />the prior I. C. Norcom High School site. <br /> <br />The purpose shall be to have confidential discussion of candidates for <br />appointment and also negotiating strategy. <br /> <br />The motion was adopted by the following vote: <br /> <br />Ayes: Heretick, Moody, Psi mas, Whitehurst, Holley <br />Nays: None <br /> <br />Motion by Mr. Whitehurst, and seconded by Mr. Moody, pursuant to Section 2.2- <br />3712(D) of the Code of Virginia, certifying that to the best of the Council Members' <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br /> <br />1. Only public business matters lawfully exempted from open meeting <br />requirements by the Virginia Freedom of Information Act, and <br /> <br />2. Only such public business matters as were identified in the motion, by which <br />the Closed Meeting was convened, were heard, discussed or considered in <br />the meeting by the City Council. <br />
