December 2. 2008 At a Called Meeting of the City Council on Tuesday, December 2, 2008, there were present: Vice Mayor William E. Moody, Jr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psimas, Douglas L. Smith, Charles B. Whitehurst Sr., City Manager Kenneth Chandler, City Attorney G. Timothy Oksman. 08 - 507 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the 6th Floor Conference Room, 801 Crawford Street, 6:00 p.m., Tuesday, December 2, 2008 for the purpose of a Closed Meeting. By order of the Mayor." 08 - 509 - Motion by Ms. Randall, and seconded by Mr. Whitehurst, to go into Closed Meeting pursuant to provisions of Section 2.2-3711 (A) of the Code of Virginia, to discuss personnel matters involving individuals, identifiable employees as per subsection 1, the disposition of publicly owned real estate, as per subsection 3, and also matters requiring the advice of legal counsel, as per subsection 7. The subjects of the meeting are: personnel and legal matters related to compensation for public safety officials legal matters related to economic incentives for the APM Portsmouth Terminal The purpose of the meeting is to permit discussion of strategy and negotiating position on these issues. The motion was adopted by the following vote: Ayes: Heretick, Psi mas, Randall, Smith, Whitehurst, Moody Nays: None Motion by Mr. Heretick, and seconded by Mr. Moody, pursuant to Section 2.2- 3712(D) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and 2. Only such public business matters as were identified in the motion, by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council. The motion was adopted by the following vote. Ayes: Heretick, Psi mas, Randall, Smith, Whitehurst, Moody Nays: None On motion, meeting adjourned at 9:35 p.m.
