<br />November 25. 2008 <br /> <br />2. Clyde Gay, 1031 Holladay Street, spoke in support of this item. <br /> <br />Motion by Ms. Psi mas, and seconded by Mr. Whitehurst, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE TO AMEND SECTIONS 35-186, 35-187, AND 35-188 AND REPEAL <br />SECTION 35-191 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (2006), <br />PERTAINING TO TAX EXEMPTIONS FOR REHABILITATED PROPERTY." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Whitehurst, Holley <br />Nays: None <br />Abstain: Smith (participate in the tax exemption program) <br /> <br />- New Business - <br /> <br />08 - 500 - Boards and Commissions <br /> <br />There were no appointments. <br /> <br />08 - 501 - Items Submitted by Council Members <br /> <br />'" Mr. Moody asked that City Council revisit the ordinance pertaining to banners in the <br />Downtown area and asked that the Management staff bring back a revision of this <br />ordinance for Council consideration. <br /> <br />'" Mr. Whitehurst also asked that any ordinances that were not "business friendly" be <br />revisited and revised for Council consideration. <br /> <br />'" Mr. Moody asked that the ordinance regarding banners be repealed and asked staff <br />discontinue citing businesses for banners. <br /> <br />'" Senior Deputy City Attorney George Willson informed City Council that any code <br />enforcement on the books has to be enforced. He also informed City Council that <br />because the sign ordinance is part of the zoning ordinance this request to change <br />the ordinance would have to be referred to the Planning Commission for <br />consideration and then come back to the City Council for consideration. <br /> <br />'" Mr. Moody asked if City Council could just amend the part of the zoning ordinance <br />that deals with banners. <br /> <br />'" Mr. Willson informed City Council that individual sections of the zoning ordinance <br />could be amended and that City Council did not have to wait until adoption of the <br />new zoning ordinance that is currently being drafted.. <br /> <br />'" City Clerk Debra White for clarification informed City Council that a resolution will be <br />drawn up by Management staff for Council's consideration, referring to the Planning <br />Commission, Mr. Moody's request to amend or repeal the code section(s) pertaining <br />to banners. <br /> <br />'" Mr. Willson informed City Council that a resolution would be drawn up referring Mr. <br />Moody's request to the Planning Commission and that an additional resolution would <br />be drawn up to temporarily suspend citing businesses with banners if permissible by <br />law. The resolution(s) will be presented for City Council consideration at the <br />December 9,2008 City Council meeting. <br /> <br />08 - 502 - Report on Pending Items <br /> <br />There were no pending items. <br />
