<br />October 28, 2008 <br /> <br />(c) Will be provided with sufficient landscaping to Insure compatibility with <br />surrounding uses; <br /> <br />(d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br />(e) Will be In accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br />2. That the City of Portsmouth Department of Public Utilities is hereby <br />granted a use permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, <br />Virginia (2006) to construct and operate a sewer pump station at 512 South Street <br />Parkway, Portsmouth, Virginia, and being more particularly described as: <br /> <br />UP-08-16 <br />512 South Street <br /> <br />That parcel described as beginning at a property pin located at the northeast corner of <br />the property at on County Street. Thence, proceeding S 03014'30"E, 81.50 feet more or <br />less to a point thence, thence proceeding S 86058'00"W 44.00 feet more or less to a <br />point, thence proceeding N 03014'30"W 81.50 feet more or less to a point, thence <br />proceeding N 86058'00"E 44.00 feet more or less back to the point of beginning. <br />Property is also known as Tax Map 13, Parcel 127 and 512 South Street. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The applicant shall construct the pump station and provide landscaping in <br />accordance with the submitted plans that were approved by the Downtown Design <br />Committee. The Director of Planning may approve minor modifications. <br /> <br />(b) Noise and/or odor produced by the site shall not adversely impact neighboring <br />property owners. <br /> <br />(c) The generator shall only be run from 7 a.m. to 6 p.m. on weekdays, except <br />during emergencies. <br /> <br />(d) City staff visits to the site for normal routine maintenance shall only occur from 7 <br />a.m. to 6 p.m. on weekdays, except during emergencies. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City CounciL" <br /> <br />Ayes: Heretick, Moody, Psi mas, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />Motion by Mr. Whitehurst, and seconded by Ms. Psimas, to adopt the following <br />resolution approved on first reading at the October 14, 2008 meeting, and was adopted <br />by the following vote: <br /> <br />08-434 (b): <br /> <br />1.
