<br />October 14. 2008 <br /> <br />(e) Will be In accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br />2. That L. Louise Lucas is hereby granted a use permit pursuant to Section <br />40-43.1 of the Code of the City of Portsmouth, Virginia (2006) to operate an adult day <br />program and an adult residential care center at 2700 London Boulevard, and being <br />more particularly described as: <br /> <br />UP-08-15 <br />2700 London Boulevard <br /> <br />Beginning at a pin located at the northwestern intersection of Broad St and London <br />Boulevard. Thence proceeding N 247.08 feet more or less to a point thence, W 239.71 <br />feet more or less to a point thence, S 256.36 feet more or less to a point thence, W, <br />29.36 feet more or less to a point thence, S 21.46 feet more or less to a point thence, E <br />161.84 feet more or less to a point thence E 182.90 feet more or less to a thence, N <br />11.52' to the point of beginning. The Property is further described as Map 158, Parcel <br />93. <br /> <br />4. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The facility shall be limited to 25 day support clients and eight adult residential <br />care clients. <br /> <br />(b) Operation of the day support facility shall be limited to between the hours of 7:00 <br />a.m. and 5:00 p.m., Monday through Friday. <br /> <br />(c) The applicant shall comply with all applicable codes, ordinances and regulations <br />of federal, state and local governments and shall obtain all necessary licenses and <br />permits. <br /> <br />(d) The facility shall be inspected annually by Fire Department, the City Health <br />Department and the State Fire Marshall. <br /> <br />(e) Any vans parked at the facility shall be parked along the western property line <br />near the rear of the property. <br /> <br />(f) At least four handicapped parking spaces must be provided on the site. <br /> <br />(g) Taxes and fees associated with the property shall be paid when due. <br /> <br />(h) All privacy fencing must be maintained in good condition. <br /> <br />(i) A Group 1 Landscape buffer shall be installed along the western property line in <br />areas that abut residentially zoned property. Shrubbery shall be installed intermittently <br />between the existing trees planted along London Boulevard and Broad Street. <br />Additionally, a four-foot high wrought iron fence shall be erected along the southern and <br />eastern property lines excluding entrances to the site. <br /> <br />(j) A landscape plan showing the recommended changes must be submitted to the <br />Planning Department for review and approval prior to the issuance of a certificate of <br />occupancy. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Moody, Psimas, Randall, D.
